147.12 SICK LEAVE RULES.
   Full-time employees shall be entitled to sick leave in accordance with the following rules:
   (a)   Each full time employee shall earn one hundred twenty (120) hours of sick leave per year, prorated over each pay period during the year. In the event the employee is suspended without pay, his/her sick leave shall be reduced by 0.0575 hours for every hour of work missed due to suspension. Overtime and paid time off (i.e. holidays and vacations) shall have no effect upon the calculation of sick leave.

   (b)   Sick leave shall be defined as an absence with pay necessitated by illness of or injury to the employee or the employee’s immediate family member living with the employee, or exposure by the employee to a contagious disease communicable to other employees. (Ord. 2016-34. Passed 1-11-17.)
   (c)   The sick leave herein provided shall apply to scheduled work days only.
   (d)   The sick leave herein provided for shall be cumulative without limit. Cumulative means the accumulations of all unused sick leave for any number of years.
   (e)   An employee who is absent on sick leave shall notify his supervisor or designee of such absence and the reason therefor prior to start of his work shift each day he is to be absent. At least two hours prior notification is required.
   (f)   Sick leave may be used in segments of not less than one hour.
   (g)   Before an absence may be charged against accumulated sick leave, the Mayor or the Mayor’s designee may require such proof of illness or injury as may be satisfactory to him/her or may require the employee to be examined by a physician designated by the Mayor or the Mayor’s designee and paid by the Village.
   (h)   If the employee fails to submit adequate proof of illness or injury upon request of the Mayor or the Mayor’s designee, or in the event that upon such proof as is submitted or upon report of medical examination, the Mayor or the Mayor’s designee, finds that there is not satisfactory evidence of illness or injury sufficient to justify the employee’s absence, such leave may be considered an unauthorized leave and shall be without pay.
   (i)   An abuse of sick leave or the patterned use of sick leave shall be just and sufficient cause for discipline as may be determined by the Mayor or the Mayor’s designee.
   (j)   The Mayor or the Mayor’s designee may require an employee who has been absent due to personal illness or injury, prior to and as a condition of his/her return to duty, to be examined by a physician and paid for by the Village, to establish that he/she is not disabled from the performance from his/her normal duties and that upon his/her return to duty will not jeopardize the health and safety of the other employee.

   (k)   For employees hired on or prior to January 1, 1998, and effective January 1, 1998, two Sick Leave Banks shall be established. Bank 1 shall contain any and all accrued and unused sick leave through December 31, 1997, and shall be frozen. Bank 2 shall contain any and all accrued and unused sick leave hours commencing January 1, 1998. Effective January 1, 1998, employees described in this subsection who use approved sick leave hours shall have these hours deducted from Bank 1 until it is exhausted. At that time Bank 1 shall cease to exist for such employees and the terms and conditions of sick leave hours usage and payment shall be administered as Bank 2 hours.

   (l)   For employees hired on or after January 1, 1998, any and all sick leave hours accrued and/or used shall be administered as Bank 2 hours.
   (m)   Employees who have accumulated and unused sick leave hours in Bank 1 shall at the time of retirement or death be paid a lump sum for such sick leave hours up to a maximum of 120 days (960 hours) based on the daily based pay of the employee, exclusive of overtime, at the time of his retirement or death. For the purposes of this section an employee shall be deemed to be retired when he/she applies for and obtains a disability or retirement pension under any pension plan afforded such employee as a result of his/her public employment.
   (n)   Employees who have unused sick leave hours in Bank 2 at the time retirement from active full-time service with the Village and with ten or more years of continuous service with the Village, shall be paid in cash for one-third (1/3) of the employee’s accrued but unused sick leave, up to a maximum accrual of 960 hours or a maximum payout of 320 hours. The dollar value of sick day shall be based on (a) employee’s annual base salary of 320 hours. The dollar value of sick days shall be based on (a) employee’s annual base salary at time of retirement, and (b) a work
year of fifty-two weeks and five days per week. For this calculation paid vacation days and holidays are considered work days. Payment for sick leave on this basis shall be considered to eliminate all sick leave credit accrued by the employee at that time. This section shall only apply to the retirement of full-time Village employees pursuant to state retirement laws and shall not be deemed applicable to any removal, voluntary or involuntary resignation, or any other like termination except a retirement as set forth herein.

   (o)   Employees hired on or after January 1, 1998, shall, as a term and condition of employment, be required to waive any previously accumulated sick leave credit from public service outside Orange Village, unless otherwise requested by the Mayor and approved by an ordinance of Council. If awarded at the time of hire, any previously accumulated sick leave credit from public service outside Orange Village shall not be subject to any payout provision contained in this Section.
   (p)   The Mayor may recommend additional or revised sick leave that is different than the leave provided for in this Section. Such additional or revised sick benefit may be granted by a motion and the affirmative vote of at least four members of Council. (Ord. 2016-34. Passed 1-11-17.)
