(A) (1) The following non-exempt employees shall receive one and one-half hours of compensatory time for time worked in excess of 40 hours in a workweek:
(a) Utility Clerk;
(b) Street/Utilities Superintendent;
(c) Wastewater operator;
(d) Street/utilities laborers.
(2) Eligible employees may accrue up to 240 hours of comp time for any hours worked over 40 hours in a week. Once an employee accrues 240 hours of compensatory time, then the employee will receive compensation for any overtime worked thereafter at a rate of one and one-half of their regular hourly rate until their compensatory time accrual is reduced below 240 hours. Comp time may carry over from year to year. The town may direct employees to take comp time off at any time to reduce an employee’s accrued comp time.
(B) The following employees are exempt from FLSA overtime regulations and are not entitled to overtime pay or compensatory time.
(1) Clerk-Treasurer;
(2) Town Marshal.
(C) (1) The Deputy Marshal is a non-exempt employee and shall receive one and one-half hours of compensatory time for time worked in excess of 160 hours during a 28-day work cycle.
(2) The Deputy Marshal may accrue up to 480 hours of comp time. Once the Deputy Marshal accrues 480 hours of compensatory time, the employee will receive compensation for any overtime worked thereafter at a rate of one and one-half of his or her regular hourly rate until their compensatory time accrual is reduced below 480 hours. Comp time may carry over from year to year. The town may direct employees to take comp time off at any time to reduce an employee’s accrued comp time.
(D) Pursuant to Fair Labor Standards, time worked” shall not include paid vacation days, paid sick days, paid holidays, compensatory time off, or other paid special absences for purposes of calculating overtime.
(E) Eligible employees must obtain prior written approval from the employee’s immediate supervisor before the employee works any overtime hours in a work period. Any violations of this policy shall subject the offending employee to discipline under the Oolitic Town Code.
(F) All requests to use comp time must be submitted to the employee’s immediate supervisor for consideration. Requests to use comp time must be approved by the employee’s immediate supervisor submitted prior to the publication of the monthly schedule for which the request pertains. Requests to use comp time will be considered on a “first come, first served” basis and will be approved so long as it does not unduly disrupt the town’s operations.
(G) Comp time shall be used at a minimum of two-hour increments.
(H) Upon separation of employment for any reason, employees shall receive compensation for any accrued, but unused comp time. The hourly rate shall be computed using the average of the employee’s previous three years’ base hourly wage. If the employee worked fewer than three years, the hourly rate shall be computed using the average base hourly wage paid to the employee during their employment.
