(A) Whenever the Town Council shall, by ordinance, declare any sidewalk in the town to be out of repair, the Town Council shall direct the Town Marshal to report specifications for the repair of such sidewalk.

(B) Upon the report of such specification, it shall be the duty of the Clerk-Treasurer to issue a notice to the owner of the lot adjoining such sidewalk, requiring him or her to repair such sidewalk in accordance with such specifications within 30 days from the time of the service of such notice. Said notice shall be served upon such owner (if he or she be a resident of said town) by the Marshal of said town, by reading or by leaving a copy thereof at his or her last or usual place of residence. If he or she be a non-resident of said town or unknown, the Clerk-Treasurer shall cause such notice to be published for one week in a weekly newspaper printed and published in said town.

(C) At the expiration of 30 days from the date of service of such notice, should owner have failed or refused to make such repair agreeable to such notice, it shall be the duty of the Street Department to repair such sidewalks in accordance with such specifications and upon completion thereof, he or she shall make report under oath to the Town Council showing that the repairs have been done according to such specifications and the amount of expense incurred thereby, which expense shall thereupon be ordered by said Town Council to be paid to the Town Marshal, pursuant to applicable law.
