(a) Definition. For purposes of this Chapter, an "Under-speed vehicle" shall have the same meaning as Ohio R.C. 4501.01(XX).
(b) Requirements. Any Under-speed vehicle to be operated in the City shall be required to have the following:
(1) Adequate brakes and braking system;
(2) Equipped with properly working brake lights, head lights, tail lights, and warning devices, also known as turn signals, as described in Ohio R.C. 4511.39;
(3) A properly working steering mechanism;
(4) A windshield to prohibit injury from any debris from the roadway;
(5) A rear view mirror to reflect the operator a view of the public street or highway to the rear; and
(6) Appropriate tires that are free of major bumps, bulges, breaks, or any condition that would be cause for unsafe conditions;
(7) A slow moving vehicle emblem displayed on the rear of the vehicle;
(8) Operated by a person over the age of 16 that possesses a valid driver's license.
(c) Operation. No person shall operate an Under-speed vehicle upon any street with a speed limit not greater than thirty-five miles per hour and upon a street that is over two (2) lanes wide, unless the operator has done the following:
(1) Submitted the Under-speed vehicle to an inspection by the City of Ontario Police Force to determine if the Under-speed vehicle meets the requirements set forth in section (b) above. Inspections are limited to persons residing in the City of Ontario and operation is limited to streets within the City of Ontario;
(2) Upon passing the inspection in (c)(1) above, notify the Service-Safety Director of such passage on a form approved by the Service-Safety Director.
(3) At all times while operating an Under-speed vehicle, the operator of an Under-speed vehicle shall keep the form set forth in (c)(2) above with the Under-speed vehicle. Failure to show said documentation of a successful inspection to law enforcement shall be a violation of this Section.
(d) Penalty. Except as otherwise provided in this division, whoever violates division (c) of this section is guilty of a minor misdemeanor. If within one year of the offense, the offender previously has been convicted of or pleaded guilty to one predicate motor vehicle or traffic offense, whoever violates this section is guilty of a misdemeanor of the fourth degree. If within one year of the offense, the offender previously has been convicted of two or more predicate motor vehicle or traffic offenses, whoever violates this section is guilty of a misdemeanor of the third degree.
