351.16 SUSPENSION OF ENFORCEMENT OF NO PARKING ZONES DURING SPECIAL EVENTS.
   (a)   The Police Chief or the Watch Commander on duty are hereby authorized to suspend the enforcement of no parking zones on streets where no parking is allowed on either side within this City upon the written application of a landowner in the immediate vicinity of the no parking zone and upon the Chief’s or Watch Commanders’ on duty determination that the non- enforcement of no parking zones will not unreasonably hamper the flow of traffic or the safety of motorists.
   (b)   No waiver shall be granted for a period of more than six hours, that waivers shall be available only for social non-commercial events, that the total area of non-parking enforcement shall be limited to the minimum necessary, that waivers shall not be granted to any applicant more frequently than four times a year, that no waivers shall be granted on any state highway, West Fourth Street, Lexington-Springmill Road, or at any other location where motor vehicles cannot be parked safely along the side of the road or street and still allow traffic to proceed on that road or street.
   (c)   The Police Chief or Watch Commanders on duty are directed to apply this section as uniformly as traffic patterns, the width of payment, the time and duration of the requested waiver and safety of the motoring public shall permit.
   Upon the granting of a waiver of parking enforcement, no parking tickets shall be issued and no motor vehicles towed for violation of parking regulations provided that in the event of an emergency a vehicle may be towed at City expense. Before towing such vehicle, efforts shall be made to contact the owner and the holder of the parking enforcement waiver.
