(a) As used in this section, the term engine retarder shall be defined to include but not limited to C Brakes, Pac Brakes, Tek Brakes, Jake Brakes and any other type of engine compression retarder commonly used on heavy-duty diesel trucks.
(b) No person shall operate or apply an engine retarder while operating a motor vehicle on any street or highway within this City. This prohibition shall not apply to fire trucks or other public safety vehicles.
(c) The Mayor is directed to post signs at appropriate locations advising motorists of the prohibition of this section.
(d) Whoever violates subsection (a) hereof shall be guilty of a minor misdemeanor and upon a second or subsequent conviction within one year of the first, a misdemeanor of the fourth degree.
