331.45 COMMERCIAL TRACTOR OPERATION PROHIBITED.
   (a)   As used in this section the term "commercial tractor" shall be defined as follows:
   "Commercial tractor" means any motor vehicle except an agricultural tractor, having motive power designed or used for drawing other motor vehicles, or designed or used for drawing another motor vehicle while carrying a portion of such other motor vehicle or its load, or both.
   (b)   No person shall operate a commercial tractor on that part of the North Stumbo Road between West Fourth Street and Village Mall Drive, except for the purpose of making a delivery or pickup on such streets.
   (c)   The Street Commissioner is directed to erect signs containing the prohibition of subsection (b) hereof at appropriate locations on North Stumbo Road and Village Mall Drive.
   (d)   Whoever violates subsection (b) hereof shall be guilty of a minor misdemeanor and upon a second or subsequent conviction within one year of the first, shall be guilty of a misdemeanor of the fourth degree.

   (e)   Except as otherwise provided in this subsection, whoever violates this section is guilty of a minor misdemeanor. If, within one year of the offense, the offender previously has been convicted of or pleaded guilty to one predicate motor vehicle or traffic offense, whoever violates this section is guilty of a misdemeanor of the fourth degree. If, within one year of the offense, the offender previously has been convicted of two or more predicate motor vehicle or traffic offenses, whoever violates this section is guilty of a misdemeanor of the third degree.
