(a) The City shall not be charged with the care, control, maintenance or repair of any culvert, of any type or nature, which has not been properly installed prior to the passage date of this chapter.
(b) For purposes of this chapter, "properly installed" means, being material of corrugated pipe, being in size sufficient to allow proper drainage and in level sufficient to allow proper drainage.
(c) The City shall not be charged with new installation of any culvert for the benefit of private property. In order to insure the proper installation of culverts the City may through the Street Department install new culverts if requested by the adjoining property owner, provided, however, that the private property most benefited pay the cost of materials thereof.
(d) The City may determine whether or not a culvert has been properly installed as defined by subsection (b) hereof and may maintain, repair and control all such culverts as are determined to have properly been installed.
