913.05 DEVELOPMENT REQUIRED TO PAY ROAD IMPACT FEE.
   (a)   Except as provided in subsection (b) hereof, all development within the City of Ontario shall pay, as a condition of development approval, a road impact fee according to the terms and conditions of this chapter.
   (b)   The following development shall not be required to pay to the road impact fee imposed by this chapter:
      (1)   Alterations or expansion of an existing dwelling unit where no additional units are created and the use is not changed:
      (2)   The construction of accessory buildings or structures which are not dwelling units and which do not constitute an increase in intensity of use under the Zoning Ordinance and do not generate additional traffic;
      (3)   The replacement of a destroyed or partially destroyed building or structure, with a new building or structure of the same size and use;
      (4)   Publicly owned governmental buildings, except for those used for permanent or temporary housing; and
      (5)   Development waived by the Impact Fee Review Board where the additional traffic generated by the development has an insignificant impact on the level of service of the street and traffic control systems.
