1612.10 APPEALS.
   The owner, agent or operator of any structure or premises shall have the right to appeal from any order of, or written notice issued by, the Fire Chief, or from any notice of a revocation of a certificate of occupancy (occupancy permit) within fifteen days from the date such notice was given or mailed or order issued. Such owner, agent or operator shall further have the right to appear before the Board of Building Code Appeals, at a time and place fixed by the Board, to show cause why he or she should not comply with such notice or order. Such appeal must be in writing. Failure to file a written appeal with the Board within such time shall constitute a waiver of the right to appeal. Except in cases of emergency as set forth in Section 1612.06, the filing of an appeal from any such notice or order shall suspend action on the enforcement of such notice or order until the appeal is acted upon by the Board.
