1464.05 SECURITY FOR DAMAGES.
   An application hereunder shall be accompanied by a cash deposit in the sum of ten thousand dollars ($10, 000) as an indemnity for any damage which the City may sustain by reason of injury to any highway, street, alley, sidewalk, fire hydrant or other property of the City, which may be caused by or be incidental to the removal of the building over, along or across any street in the City and to indemnify the City against any claim of damages to persons or private property, and to satisfy any claim by a private individual arising out of, caused by or incidental to the moving of any building over, along or across any street in the City.
   (a)   Bond. Any person filing an application hereunder may, in lieu of the general cash deposit required above, file with the Safety Director a bond, approved as to form by the Director of Law and executed by a bonding or surety company authorized to do business in the State, in the amount of fifty thousand dollars ($50,000), conditioned on the faithful performance by the applicant of all of the requirements of this chapter and the rules and orders promulgated under it. Such bond shall run to the City for the use and benefit of any person intended to be protected by this chapter and shall be conditioned on the payment for any damage to public or private property and the payment for any damage or loss resulting from any malfeasance, misfeasance or nonfeasance or negligence in connection with any of the activities or conditions upon which the permit applied for is granted. Not less than seven nor more than thirty days following the completion of the work for which the permit is issued, unless during such period a claim has been filed with the Safety Director stating that damage has been done to property within the City or that injury has occurred to a resident of the City or that injury has occurred within the City to any other person, the Safety Director shall report such completion to the Clerk of Council for consideration at the next regular meeting of Council. At the next regular meeting of Council, Council shall order the release of the surety unless it then appears that a claim is forthcoming, in which case the matter shall be continued for a maximum further period of thirty days during which such claim shall be filed. If no such claim is filed with the Safety Director within that time, the Safety Director shall, at the expiration of the thirty-day period, notify the surety of its release.
   (b)   Insurance. Any person filing an application hereunder shall, in addition to the general cash deposit or bond required above, submit a certificate of insurance issued by an insurance company qualified and admitted to do business in the State stating that the owner of the structure to be moved and the person responsible for the moving operation are covered by liability insurance for the operations to be performed in minimum amounts of two hundred fifty thousand dollars ($250,000) per person and five hundred thousand dollars ($500,000) aggregate per occurrence for bodily injury, and one hundred thousand dollars ($100,000) per accident for property damage. A current copy of the workmen's compensation certificate shall also be required.
