1448.07 CERTIFICATE OF OCCUPANCY AND ZONING COMPLIANCE.
   (a)   No person, firm, corporation or other entity shall move into or occupy any building, property, or portion thereof, in the City, excluding residential occupancies, until a certificate of occupancy/zoning compliance is issued by the Building, Housing and Zoning Administrator. The owner/tenant of such building shall apply for a building inspection and an occupancy permit on forms to be supplied by the City. Upon receiving such application, the Building, Housing and Zoning Administrator shall, within reasonable time, cause an inspection of such premises to be made. The Building and Zoning Administrator may also require concurrent inspections by personnel from other agencies (e.g. Police, Fire, Service, Health, etc.).
   (b)   Fees for such building/occupancy inspection shall be charged as follows:
 
(1)   Inspection fees
A. Base fee - (under 3,000 sq. ft. gross floor area)
$150.00
B. Each additional 1,000 sq. ft. or part thereof
$10.00/ea.
 
      (2)   Fire Department occupancy inspection fees shall be determined in accordance with Section 1448.08.
   (c)   If the Building, Housing and Zoning Administrator determines from such inspection reports that the property is safe and sanitary and complies with all applicable laws and regulations relating to it, then the Building, Housing and Zoning Administrator shall issue to the owner thereof an occupancy permit allowing occupancy and use of the building or space.
   (d)   If the Building, Housing and Zoning Administrator determines from such inspection reports that the property is unsafe, inadequate or unlawful, they shall notify the owner of the fact in writing, specifying the corrective action which must be taken before an occupancy permit will be issued. In such case, the issuance of the occupancy permit shall not be effective until the property is re-inspected and found to be in compliance with all applicable laws, regulations and ordinances. The fee for each re-inspection is Fifty dollars $50.00 per inspection
   (e)   A sublease or assignment of a lease shall make the sublessor or assigner liable to compliance with this section prior to his or her allowing the sublessee or assignee to take occupancy.
   (f)   The fee for a certificate of zoning compliance is one hundred dollars $150.00.
   (g)   Any charges incurred by the owner in meeting the requirements of this section shall in no way be construed to be the responsibility of the City.
