1042.09 SUPPLEMENTARY ASSESSMENT FOR MAINTENANCE, REPAIR AND CONSTRUCTION.
   (a)   There is hereby assessed the amount of seventy dollars ($70.00) per quarter for each lot upon which an improvement exists and twenty dollars ($20.00) per quarter for each unimproved lot, commencing with the second quarter of 1983.

   (b)   The assessments set forth in subsection (a) hereof shall be due and payable at the office of the Director of Finance within thirty days after the close of each calendar quarter for each year for which such assessment is levied. If not so paid, the assessments shall be certified to the County Auditor and the County Treasurer and shall be collected in the same manner as other City taxes upon the tax duplicates for the relevant years. The Director shall furnish to the Auditor and the Treasurer such other information as is necessary to permit the identification of the property against which the sewer maintenance assessment has been made and remains unpaid.
   (c)   The amounts specified in subsection (a) hereof, as restricted, shall be deposited and maintained in a restricted fund to be established by the Director, the proceeds from which may be used only for capital improvements necessitated by the depreciation, aging and inadequacy of the originally installed sewerage system. If there is an existing indebtedness for such capital improvements at the time such funds are actually collected, such funds may also be used to retire such existing indebtedness. The remainder of the funds collected shall continue to be maintained in the sewer maintenance fund established by Ordinance 68-77, passed December 13, 1977, to be used for current management, maintenance, operation and repair of the sewerage system. Whenever Council deems the amount thus on deposit to be in excess of the amount reasonably necessary for such purposes, Council may transfer all or part of the excess amount to the restricted capital improvement fund, which transfer shall be permanent, and after which the sewer maintenance fund may be used for the same purposes as the capital improvement fund.
