(a) Pursuant to Ohio R.C. 727.38 and 729.49, an assessment and charge is hereby levied against the properties benefited by the Main Street Sewer Plant in such amount as determined by Council from time to time, which amount is necessary to continue the operation of such Plant as more fully set forth in the cost estimates and records on file in the Finance Department of the City. (b) Furthermore, each benefiting property owner shall be liabile for any and all costs of repairs to or replacement of any portion of such Plant. Such costs shall be borne equally by each benefiting property if such costs exceed available funds deposited in the replacement escrow account. Such additional charge shall be levied without exception.
