(a) All trees in the streets of the City, or on public property owned by the City, within a reasonable distance, as determined by the Building Inspector, of any excavation or construction of any building, structure or street work, shall be guarded with a protective device, such as a substantial fence, frame or box, not less than four feet high and eight feet square, or at a distance in feet from the tree equal to the diameter of the trunk in inches, measured at a trunk height of approximately four and one-half feet from the ground (D.B.H.), whichever is greater. All building material, dirt and other debris shall be kept outside such barrier. The protective device must be structurally sound and capable of protecting the tree from all anticipated encroachment by debris and machinery associated with the excavation and/or construction.
(b) No person shall excavate any ditch, tunnel or trench, or lay any drive, within a radius of ten feet from any tree in a street to the City, or on public property owned by the City, except by written permission of the Building and Zoning Inspector.
