(a) Pursuant to 47 C.F.R. 76.934, the Council may permit a small system, as defined in 47 C.F.R. 76.901, to certify that the small system's rates for basic service and associated equipment comply with 47 C.F.R. 76.922.
(b) A system seeking the certification described in subsection (a) hereof must file a petition to this effect with the Staff.
(c) Within a reasonable time of receiving such a petition, the Staff shall issue a public notice, as described in Section 806.07, stating that it has received such a petition. The notice will provide the address of the Staff office where the petition will be available for public viewing within specified times. The notice will also provide the address and telephone number of the cable operator. The cable operator is required to provide interested parties with copies of the petition. In addition, the notice will also provide a date for the presentation of a recommended decision by the Staff to the Council and shall set a date by which the Council must act upon the recommended decision, which shall be at least thirty days after the submission of the Staff's recommended decision. If the Council takes no action by the date designated by the Staff, then the recommended decision shall be considered a final decision.
(d) After the Staff issues the public notice described in subsection (c) hereof, interested parties will have five business days to file written comments with the Staff. There is no prescribed format for these comments.
