202.08 REIMBURSEMENT TO CITY OF COSTS OF CONFINEMENT IN JAIL.
   (a)   Any person convicted of an offense under any section of these Codified Ordinances, who is thereafter confined in a municipal jail, workhouse, prison or County jail, shall reimburse the City for its expenses incurred by reason of such confinement, including, but not limited to, the expenses incurred for food, clothing, medical expenses, health care and shelter, and including, but not limited to, payments made to the City of Cleveland for confinement at its House of Correction. Chargeable costs shall include any period of incarceration before sentencing that is credited against the term of imprisonment. The amount of reimbursement shall be determined by a court of competent jurisdiction in an amount and in the manner provided by law.
   (b)   In any proceeding which is subject to this section, the City Prosecutor shall apply to the sentencing judge for a determination of the extent of the individual's duty to reimburse the City for its expenses in confining him or her, pursuant to Ohio R. C. 2929.15. However, the maximum amount permitted by Ohio R.C. 2929.15(B) shall not apply. The actual amount to be paid shall not exceed the actual costs of confinement. The City Prosecutor shall advise the Chief of Police of the outcome of such proceedings.
   (c)   The Chief shall maintain records of the maximum amount of expenses which are chargeable to each prisoner according to this section and, upon each prisoner's release, shall bill the prisoner for the reimbursement of those expenses, subject to any limitations which have been ordered by the sentencing judge.
   (d)   The Director of Law is hereby authorized to institute an appropriate civil action in the name of the City in a court of competent jurisdiction to recover from the convict the reimbursement for the expenses of his or her confinement in a municipal jail, workhouse, prison or County jail as may be determined by the court in the manner provided by law.
   (e)   All amounts recovered for reimbursement of expenses or confinement pursuant to this section shall be paid into the General Fund.
