§ 17.04.610 DEFINITIONS.
   For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   CLASS B SEAL.
      (1)   B1 SEAL. The unit has been inspected and found to be in compliance with applicable codes and standards for human habitation.
      (2)   B2 SEAL. The unit has been inspected and found not to be in compliance with applicable codes, is a salvage unit unfit for human habitation, and shall be sold only for the purpose of use as a storage or utility building.
   CERTIFIED INSTALLER. A certified installer is a individual certified to install manufactured homes in the State of Kentucky pursuant to the administrative regulations of 815 KAR 25:080, requirements for certifying manufacture home installers.
   COMPATIBILITY STANDARDS. Standards that have been enacted under the authority of this section for the purpose of protecting and preserving the monetary value of real property located within the city.
   FACTORY BUILT HOME. A residential dwelling that is wholly or substantial part, made, fabricated, formed, or assembled in manufacturing facilities for installation or assembly on a building site. FACTORY BUILT HOMES shall include, but not be limited to, manufactured homes, modular homes,
and mobile homes.
   HUD LABEL. This is the label affixed to a new manufactured home by the manufacturer after it has been approved by a third party inspector, as required under the HUD Act being 42 U.S.C. §§ 5301 et seq., (sometimes referred to as ‘A’ seal).
   INSTALLATION. The work performed on site and the operations involved in the delivery, permanent securing, and placement of a manufactured home for the purpose of human occupancy as detailed in 815 KAR 25:090.
   KENTUCKY RESIDENTIAL CODE. The current One- and Two-Unit Residential Dwelling Code being 815 KAR 7:125, as adopted by the State of Kentucky.
   MANUFACTURED HOME. A single-family residential dwelling unit constructed after June 15, 1976, in accordance with the National Manufactured Home Construction and Safety Standards Act of 1974 being 42 U.S.C. §§ 5401 et seq., as amended and designed to be used as a single-family residential dwelling with or without permanent foundation when connected to the required utilities and includes the plumbing, heating, air conditioning, and electrical systems contained therein.
   MANUFACTURED HOME, CLASS A. A manufactured home constructed after July I, 1976, that meets or exceeds the construction standards promulgated by the U.S. Department of Housing and Urban Development that were in effect at the time of construction and that satisfies each of the following additional criteria:
      (1)   The minimum width of the main body of the home, as assembled in the site is not less than 24 feet as measured across 65% of the total length;
      (2)   Has a minimum area of at least 816 square feet;
      (3)   The pitch of the home’s roof has a minimum vertical rise of one foot for each five feet of horizontal run, and the roof is finished with a type of shingle that is commonly used in standard residential construction;
      (4)   The exterior siding consists of wood, hardboard, or aluminum (vinyl covered or painted, but in no case exceeding the reflectivity of gloss white paint) comparable in composition, appearance, and durability to the exterior siding commonly used in standard residential construction;
      (5)   A continuous permanent masonry foundation, unpierced except for required ventilation and access, is installed under the home even if said wall is not structurally required by the manufacturer’s installation specifications; and
      (6)   The tongue, axles, transporting lights, and removable towing apparatus are removed after placement on the lot and before occupancy.
   MANUFACTURED HOME, CLASS B. A mobile home constructed after July 1, 1976, that meets or exceeds the construction standards promulgated by the U.S. Department of Housing and Urban Development that were in effect at the time of construction but that does not satisfy the criteria necessary to qualify the house as Class A manufactured home.
   MANUFACTURED HOME, CLASS C. Any manufactured home that does not meet the definitional criteria of a Class A or Class B manufactured home.
   MANUFACTURED OR MOBILE HOME LOT. A parcel of land in a manufactured or mobile home community for the placement of a single manufactured or mobile home.
   MANUFACTURED OR MOBILE HOME COMMUNITY. A parcel of land, under single or multiple ownership and developed specifically for the purpose of leasing two or more residential spaces for the location of manufactured or mobile home dwellings and which contain common facilities and utilities located on the premises.
   MOBILE HOME. A structure manufactured prior to June 15, 1976, that was not required to be constructed in accordance with the National Manufactured Housing and Safety Standards Act being 42 U.S.C. §§ 5401 et seq., that is transportable in one or more sections, that, in traveling mode is eight body feet or more in width and 40 body feet or more in length, or when erected on side, 400 or more square feet, and that is built on a permanent foundation, when connected with the permanent required utilities, including plumbing, heating, air conditioning, and electrical systems.
   MOBILE HOME PARK. Any site or tract or land at least one acre in size, upon which three or more manufactured homes used for habitation are parked, either free of charge or for revenue purposes; including any roadway, building, structure, vehicle, or enclosure used or intended for use as a part of the facilities for such park.
   MODULAR HOME.
      (1)   A dwelling unit constructed in accordance with the standards set forth in the Commonwealth Building Code and composed of components substantially assembled in a manufacturing plant and transported to the building site for final assembly on a permanent foundation.
      (2)   Among other possibilities, a MODULAR HOME may consist of two sections transported to the site in a manner similar to a mobile home (except that the modular home meets the Commonwealth Building Code) or a series of panels or room sections transported on a truck and erected or joined together on the site.
   PERMANENT FOUNDATION. A system of supports that is capable of transferring, without failure, into soil or bedrock, the maximum design loan imposed by or upon the structure; constructed of concrete and placed at a depth below grade adequate to prevent frost damage.
   QUALIFIED MANUFACTURED HOME. A manufactured home that meets all of the following criteria:
      (1)   Is manufactured on or after July 15, 2002;
      (2)   Is affixed to a permanent foundation and is connected to the appropriate facilities and is installed in compliance with KRS 227.570;
      (3)   Has a width of at least 20 feet at its smallest width measurement or is two stories in height and oriented on the lot or parcel so that its main entrance door faces the street; and
      (4)   Has a minimum total living area of 900 square feet.
