§ 50.090 SOLID WASTE MANAGEMENT FACILITIES.
   All municipal solid waste, including bulky waste, industrial waste, and CD&D shall be disposed of within a sanitary landfill or a transfer station having a valid permit issued by the Cabinet in compliance with KRS 224.40-305, 224.40-100, and 224.40-315 and a permit issued by the governing body upon compliance with §§ 50.130 et seq.

§ 50.091 OPEN BURNING.
   Open burning of municipal solid waste, construction and demolition debris, hazardous waste, or bulky waste is prohibited pursuant to KOC 05-320-315, 401 KAR 51:010, KRS chapters 149, 150, and 227, other laws of the Commonwealth of Kentucky or the federal government or local ordinances.

§ 50.092 BURNING OF GREEN WASTE.
   Burning of paper, woody, or dry green waste is prohibited while a regional or countywide burn ban is in effect with specific exceptions as cited within Chapter 92 of this code.
   (A)   All burning is prohibited in the governing body annually from May 1 through September 30 with exceptions per Chapter 92 of this code.
   (B)   The governing body shall adhere to KRS 149.400(1) Fire Hazard Seasons which mandates that no person shall set fire to, or procure another to set fire to, any flammable material capable of spreading fire, located in or within 150 feet of any woodland or brushland, except between the hours of 6:00 p.m. and 6:00 a.m., prevailing local time, or when the ground is covered with snow. These annual periods are February 15 through April 30 and October 1 through December 15.

§ 50.093 OPEN DUMPING.
   Open dumping of solid waste, including bulky waste and excluding clean fill, on all lands (i.e., roadsides, hollows, rivers, streams, lakes, and the like) by any person is prohibited by KRS 224.40-100 and this chapter.

§ 50.094 BENEFICIAL REUSE.
   Disposal of inert material as clean fill on any site for the purpose of: (1) land filling directly associated with agricultural, silvicultural, horticultural, and landscaping practices; (2) land filling associated with the preparation of a site for new construction; (3) debris filling of less than one acre is not prohibited.

§ 50.095 HAZARDOUS WASTE.
   As defined within this chapter, hazardous waste transport, storage, and disposal requires the services of a Part B Permitted TSD Facility and shall be disposed of only in a manner authorized by state and federal regulations. The county shall provide for the safe disposal of household hazardous waste at least once annually.

SOLID WASTE MANAGEMENT FACILITY SITING
§ 50.110 SANITARY LANDFILLS.
   A person seeking a sanitary landfill permit must first establish compliance with the Comprehensive Zoning Ordinance. Upon compliance being established, a solid waste facility permit application shall be submitted to the coordinator setting forth the following information:
   (A)   Statement of the exact nature and source of the materials to be used as containment, fill, and cover on the subject property.
   (B)   A site plan showing the following:
      (1)   The entire property, principal structures, accessory buildings, location of fill, and paved areas.
      (2)   All natural or historic features including, but not limited to, streams, topography, cemeteries, and endangered species habitats.
      (3)   Methods employed to control surface drainage, illegal dumping, odors, fires, and methane release during and after completion of operations.
      (4)   An operations plan which includes record keeping, reporting, containment procedures, capacity assurance, and closure procedures.

§ 50.111 CONSTRUCTION AND DEMOLITION DEBRIS LANDFILLS.
   A person seeking a construction and demolition debris landfill permit must first establish compliance with the Comprehensive Zoning Ordinance. Upon compliance being established, a solid waste facility permit application shall be submitted to the Coordinator setting forth the following information:
   (A)   Statement of the exact nature and source of the materials to be used as fill on the subject property.
   (B)   A site plan showing the following:
      (1)   The entire property, principal structures, accessory buildings, location of fill, and paved areas.
      (2)   All natural or historic features including, but not limited to, streams, topography, cemeteries, and endangered species habitats.
      (3)   Methods employed to control surface drainage, illegal dumping, and fires.
      (4)   An operations plan which includes record keeping, reporting, containment procedures, capacity assurance, and closure procedures.

§ 50.112 TRANSFER STATION.
   A person seeking a transfer station permit must first establish compliance with the Comprehensive Zoning Ordinance. Upon compliance being established, a solid waste facility permit application shall be submitted to the Coordinator setting forth the following information:
   (A)   Statement of the exact nature and source of the materials to be disposed of on the subject property, the length of time the materials will remain on site, and the ultimate destination of said materials.
   (B)   A site plan showing the following:
      (1)   The entire property, principal structures, accessory buildings, location of solid waste, traffic patterns, and paved areas;
      (2)   All natural or historic features including, but not limited to, streams, topography, cemeteries, and endangered species habitats;
      (3)   Methods employed to control illegal dumping, odors, and fires; and
      (4)   An operations plan which includes record keeping, reporting, containment procedures, capacity assurance, and closure procedures.

§ 50.113 SOLID WASTE INCINERATOR.
   A person seeking a solid waste incinerator permit must first establish compliance with the Comprehensive Zoning Ordinance. Upon compliance being established, a solid waste facility permit application shall be submitted to the Coordinator setting forth the following information:
   (A)   Statement of the exact nature and source of the materials to be incinerated, the length of time the materials and resulting waste will remain on site, and the ultimate destination of residuals.
   (B)   A site plan showing the following:
      (1)   The entire property, principal structures, accessory buildings, location of solid waste, traffic patterns, and paved areas;
      (2)   All natural or historic features including, but not limited to, streams, topography, cemeteries, and endangered species habitats;
      (3)   Methods employed to control air pollutants, odors, and fires; and
      (4)   An operations plan which includes record keeping, reporting, containment procedures, and closure procedures.
