The guarantee deposit shall be returned after the following have occurred:
(A) The debris landfill has been closed for one year; and
(B) There are no outstanding notices of violations of county, state or federal environmental laws applicable to the fill. This includes any outstanding notice of violation of the environmental performance standards outlined in 401 KAR 47:030.
