The governing bodies of cities and homeowner associations (HOA) within the county may adopt the practice of mandatory collection as defined under this chapter while adhering to §§ 50.040 et seq.

The owners of all residential dwellings occupied under the terms of a rental agreement must provide collection services for the occupants while adhering to §§ 50.040 et seq.

No person shall engage in the collecting or hauling of solid waste in the county without (a) obtaining an annual waste hauling permit from the Coordinator and (b) submitting a Form DEP 5033 annually to the Coordinator. Solid waste collectors and haulers operating within the county shall be responsible for the collection of solid waste from collection points to a transportation vehicle. Spillage or blowing litter, caused by or as a result of the actions or intentional inactions of the collector or hauler, shall be cleaned up by the collector. Spillage or blowing litter caused by improper storage of waste, as described in § 50.061, shall be considered a public nuisance as defined in § 91.01. Automated and manual collection vehicles are acceptable.

Points of collection of solid waste shall be from the roadside or curbside within public rights-of-way or other locations near buildings, parking lots, and the like on private property. In general, solid waste contained in trash carts shall be placed along the roadside or curbside fronting the subject property with the lid closed and the opening facing the road. Bulky waste and green waste shall be placed on the ground apart from trash carts for collection. Residential, agricultural, commercial, institutional, and industrial account holders using stationery storage containers shall place the container on private property in areas accessible to collection vehicles. Bulky waste and green waste may be placed in an appropriate dumpster by the account holder only.

Collection practices that are deemed acceptable by the governing body are as follows:
(A) Door-to-door household/curbside collection by route;
(B) Service of stationery storage containers by route;
(C) Temporary placement of roll-off boxes for specific projects. Placement may not be on public roads or right-of-ways; and
(D) At-the-door service for households of physically disabled people incapable of moving a collection cart to the curb.

Collection practices by route which are deemed acceptable by the governing body are as follows:
(A) All residential solid waste shall be collected at least once every week, barring Force Majeure;
(B) Agricultural, commercial, institutional, and industrial generators may adjust collection at more or less frequent intervals (i.e., every other week, twice weekly, or more) as necessary for the protection of public health, safety, and welfare; and
(C) Collection specifications concerning frequency and times of day are relegated to franchise contracts between the governing body and a solid waste collector.
