(A) Title. This subchapter shall be known as the Oldham County Road Encroachment Permit for
Excavations and Utility Construction Ordinance of Oldham County, Kentucky, and may be so cited officially.
(B) Authority. This subchapter is adopted pursuant to the statutory authority granted to Kentucky counties within KRS Chapter 67 and KRS Chapter 100.
(C) Purpose. In general, the purpose of this subchapter is to protect the health, safety, and welfare of county citizens. This includes but is not limited to the following:
(1) Ensuring any excavations that abut upon a county road and/or occur within the county right-of-way comply with applicable engineering design and construction standards;
(2) Ensuring all openings, cuts, or excavation in or under the surface of any street, alley, curb, sidewalk, shoulder, ditch, and public way within the county right-of-way comply with applicable engineering design and construction standards;
(3) Ensuring that any utility (electric, gas, water, sanitary, fiber, cable, and telecommunications) that is placed in, under, or over the county right-of-way complies with applicable engineering and construction standards;
(4) Ensuring all lane and/or road closures associated with excavations or utility construction (i.e., utility installation, maintenance, or removal) provide adequate and appropriate traffic management and signage;
(5) Establishing procedures by which the requirements of this subchapter will be enforced.
(D) Jurisdiction. This subchapter shall govern all unincorporated properties within the jurisdictional boundaries of the county, and all incorporated areas within the boundaries of the county in which the incorporated areas have passed a resolution.
