(A) Any person or entity convicted of violating § 115.04(A) of this chapter shall be deemed guilty of a misdemeanor and shall be subject to a fine of not less than $100, nor more than $500, or imprisonment for a period not to exceed 30 days, or both. Each day a violation occurs shall constitute a separate offense.
(B) Any person or entity convicted of violating any provision of this chapter other than § 115.04(A) shall be guilty of a violation and shall be subject to a fine of not less than $50, nor more than $500.
(C) In the event of any violation of federal, state, local law or ordinance, any and all fireworks may be confiscated.
