(A) Any person who is responsible for the release or substantial threat of a release of hazardous materials into the environment in violation of § 94.05 or who fails to report that release or threatened release in violation of § 94.06 shall, upon conviction thereof by a court of competent jurisdiction, be guilty of a Class A misdemeanor and subject to a fine or imprisonment or by both a fine and imprisonment as is otherwise provided by law for that offense. Each day that a violation occurs, exists or continues shall be deemed to be a separate offense.
(B) Any person who otherwise violates any provisions of this chapter other than §§ 94.05 or 94.06 shall, upon conviction thereof by a court of competent jurisdiction, be guilty of a Class B misdemeanor and subject to a fine or imprisonment or by both a fine and imprisonment as is otherwise provided by law for that offense. Each day that a violation occurs, exists or continues shall be deemed to be a separate offense.
(C) In addition to the penalties provided in divisions (A) and (B) above, any person violating any provisions of this chapter shall become liable civilly to the appropriate county or city government, for any expense loss or damage to the government or agency thereof caused by reason of the violation, including, but not limited to, any clean-up, evacuation, administration or other expenses and legal expenses.
