A. The legislature of the state of Oklahoma has in 11 Oklahoma Statutes sections 41-47, as amended, delegated the responsibility to local governmental units to adopt ordinances designed to minimize flood losses. Therefore, the city of Okmulgee, Oklahoma, ordains the following, to become effective immediately.
B. The Oklahoma legislature has, in 11 Oklahoma Statutes sections 14-111C, 22-104(2), and 82 Oklahoma Statutes section 1601 et seq., delegated the responsibility to adopt regulations designed to minimize flood losses to local governmental units. Therefore, the city council does ordain the provisions of chapter 13.40 of this title recreating a stormwater utility, this chapter regulating construction and earth excavation as it affects flooding and runoff, and chapter 13.44 of this title regulating potential pollution and actual contaminants of the floodway and drainage system.
