10.94.130: DEFINITIONS:
For the purpose of this chapter, the following terms, phrases, words and their derivations shall have the meanings given in this section. When not inconsistent with the context, words used in the present tense include the future; words in the plural number include the singular. The word "shall" is always mandatory and not merely directory.
CITY: The city of Okmulgee.
CITY MANAGER: The city manager, acting city manager or interim city manager of the city of Okmulgee.
COSTS OR COST: The expenses of removing, towing, transporting, storing, notifying the owner or other interested parties, advertising and selling a wrecked or inoperable motor vehicle or inoperable trailer.
INOPERABLE TRAILER: A trailer, the condition of which is abandoned, junked, wrecked, dismantled, partially dismantled, incapable of being pulled behind an automobile or truck upon a public street, or from which a tire(s), wheel(s) or any substantial part thereof has been removed or a tire(s) is flat.
MOTOR VEHICLE: Any vehicle which is self-propelled and designed to travel along the ground and shall include, but not be limited to, automobiles, buses, motorbikes, motorcycles, motorscooters, trucks, tractors, go-carts or recreational vehicles (RVs).
PERSON: Any person, firm, partnership, association, corporation, company or organization of any kind.
POLICE CHIEF: The chief of police of the city of Okmulgee or any officer of the police department of the city of Okmulgee.
PRIVATE PROPERTY: Any real property within the city which is privately owned and which is not "public property" as defined in this section.
PUBLIC PROPERTY: Any public way, street, alley, right of way or highway which shall include the entire width between the boundary lines of every such way and shall also mean any other publicly owned property or facility.
TRAILER: A conveyance transport with an axle(s) and tongue designed to be pulled behind an automobile or truck to provide sleeping accommodations, cook, smoke or barbecue food, or to haul animals, produce, lumber, goods, commodities, boats, trash, wood, debris, etc.
WRECKED MOTOR VEHICLE: Any motor vehicle which does not have lawfully affixed thereto an unexpired license plate and/or a current motor vehicle safety inspection certificate, and/or the condition of which is wrecked, dismantled, abandoned, junked, partially dismantled, incapable of operation by its own power on a public street, or from which the wheel(s), engine, tire(s), transmission, a tire(s) is flat or any substantial part thereof has been removed. "Inoperable motor vehicle" is a motor vehicle, the condition of which is wrecked, dismantled, partially dismantled, incapable of operation by its own power upon a public street, or from which the wheel(s), engine, tire(s), transmission, a tire(s) is flat or any substantial part thereof has been removed and/or which lawfully has affixed thereto an unexpired license plate and/or a current motor vehicle inspection certificate.
