9.12.010: ASSAULT AND BATTERY AND DOMESTIC ASSAULT AND BATTERY DEFINED AND PROHIBITED:
   A.   Definitions:
 
ASSAULT:
Any willful and unlawful attempt or offer with force or violence to do a corporal hurt to another.
BATTERY:
Any willful and unlawful use of force or violence upon the person of another.
DOMESTIC ASSAULT AND BATTERY:
Any assault and/or battery upon the person of another who is an intimate partner, engaged in a dating relationship, former intimate partner, or family member or co-habitant.
 
   B.   Prohibited:
It is unlawful for any person to commit an assault or an assault and battery within the city. Any person committing an assault or assault and battery within the city is guilty of a misdemeanor.
It is unlawful for any person to commit a domestic assault or a domestic assault and battery within the city and anyone committing a domestic assault or a domestic assault and battery within the city is guilty of a misdemeanor.
A physical arrest may be made for a domestic assault and battery committed within the city, but outside the presence of the officer, if the officer witnesses injuries resulting from the assault and battery and the officer has probable cause to believe the assault and battery occurred within the preceding 72 hours.
