9.04.100: FAILURE TO OBEY ORDER TO LIMIT OR CEASE WATER USAGE DURING EMERGENCY:
   A.   It is unlawful and an offense for any person, firm or corporation to use or continue to use water from the city's water system at such times and in such manner as are determined by the city manager or his/her designee to be limited and/or prohibited for purposes of water conservation during a water emergency declared by the city manager or his/her designee, to be necessary to protect the city and public, which emergency declaration shall be announced to the public, including all relevant details and limitations, through notice in a newspaper of general circulation throughout the city and/or notice on radio stations and/or television stations, including, but not limited to, cable television and/or notice provided in person by an employee of the city and/or any other notice in a form reasonably calculated to inform the public of the declared water emergency situation.
   B.   The city council reserves the right at all times to review any and all declarations of water emergency and to affirm, set aside and/or modify any and all such declarations for which public notice shall be provided in a form(s) as above provided. It is also unlawful and an offense for any person, firm or corporation to use or continue to use water from the city's water system at such times and in such manner as are determined by the council of the city to be prohibited during an emergency declared by the city manager and affirmed or modified by the council of the city.
   C.   Any person, firm or corporation which violates this section of the code commits an offense and shall, upon conviction, be fined in an amount of not to exceed one hundred dollars ($100.00) plus court costs, per each offense, and each day an offense continues shall be deemed a separate offense and punishable as such.
