6.20.090: APPREHENSION OF ANIMALS:
   A.   The animal control officer, police officer, or such other officer or employee of the city as the city manager may authorize shall take into custody and impound any animal running at large in violation of any provision of the ordinances of the city, may enter upon the open premises of the owner or other open private premises to take such animal into custody, and, if with reasonable effort an animal illegally at large cannot be caught, may kill it, either on or off private premises.
   B.   Notwithstanding any of the above provisions, should any dangerous animal be found running at large constituting an immediate hazard to the public's safety, and circumstances make the capture or seizure of such animal impractical or impossible, or, should any animal found running at large elude capture in spite of the exercise of reasonable efforts by responsible city officials, then, in that event, such animal may be slain or destroyed by the animal control officer or police officer using due regard for the safety and welfare of the public in the selection of the method and manner of such destruction or slaying.
   C.   It shall be an offense for any person within the city limits of the city of Okmulgee to fail or refuse to deliver to the animal control officer upon demand any unlicensed dog or cat, vicious animal, animal which is a nuisance, rabies suspected animal, dog or cat found at large, or any animal the keeping or harboring of which is declared to be an offense.
