6.20.070: DISPOSITION OF IMPOUNDED ANIMALS:
   A.   At the end of the seventy two (72) hour period prescribed in this chapter, animals that have not been claimed and redeemed by their owners shall be disposed of in one of the following manners:
      1.   The animal shall be placed with a humane society or other animal shelter facility.
      2.   The animal may be adopted by private individuals upon the following conditions:
         a.   Application of the required license for the animal, if the new owner is a resident of the city of Okmulgee.
         b.   Written agreement that, if the animal is not already sterilized, it will be sterilized within thirty (30) days for adult animals or by a specified date for pups and kittens, that the animal will be vaccinated against rabies within three (3) days for adult animals or within a specified date for pups and kittens, and deposit of funds with the releasing agency to ensure that the adopted animal will be spayed or neutered.
      3.   The animal shall be humanely euthanized by an approved method, and the carcass disposed of in an approved manner.
   B.   Animals of no apparent value taken into custody, as provided in this chapter, shall be destroyed in a humane manner by the officer or employee of the city in charge of such animal or by the animal control officer, and shall not be impounded in the animal shelter.
   C.   The animal control officer may euthanize any animal if it has been surrendered to the animal shelter. The animal control officer or police officer may destroy any animal that is so sick or injured that its cure is considered by the animal control officer or police officer to be impracticable or if death is imminent. In either of such events, such euthanization or destruction may be done immediately, without notice or any waiting period. Anyone surrendering an animal shall provide proof of his or her identity before the animal will be accepted. (Ord. 1877 § 2, 2006)
