6.12.020: PERMITS FOR COMMERCIAL ANIMAL ESTABLISHMENTS:
   A.   No person, partnership, corporation, or other entity shall operate a commercial animal establishment or animal shelter without first obtaining a permit in compliance with this section.
   B.   Any permit applicant shall submit the application to the city at locations designated by the city manager, and shall provide for humane care of all animals within its custody and conform to all provisions of this title and other applicable laws.
   C.   After a permit applicant has shown the willingness and ability to comply with this title, a permit shall be issued upon payment of the fee as established by resolution of the city council. Categories are as follows:
      1.   Kennel with capacity of fewer than ten (10) dogs or cats.
      2.   Kennel with capacity of ten (10) or more, but fewer than fifty (50) dogs and cats.
      3.   Kennel for fifty (50) or more dogs and cats.
      4.   Pet shop.
      5.   Riding stable.
      6.   Animal auction.
      7.   Zoological park.
      8.   Circus.
      9.   Grooming shop.
      10.   Petting zoo.
   D.   The permit period shall begin with the calendar year and shall run for one year. Renewal applications may be made as early as one hundred eighty (180) days prior to the start of the calendar year, and must include proof of a current permit at the time of filing for renewal. Persons applying for a permit during the permit year shall be required to pay a prorated fee as determined by the city manager or his designee.
   E.   Every facility regulated by this title shall be considered a separate enterprise, requiring separate permits.
   F.   Persons operating kennels for the breeding of dogs or cats may elect to license such animals individually.
   G.   No animal permit fee is required of any veterinary hospital, animal shelter or government operated zoological park.
   H.   Failure to obtain a permit before opening any facility covered in this section shall result in a fine as established by resolution of the city council.
   I.   Any person who has a change in the category under which a permit was issued shall be subject to reclassification and readjustment of the permit fee. (Ord. 1877 § 2, 2006)
