1.12.010: PENALTIES AND FEES:
   A.   Except in cases where a different punishment is now or may hereafter be prescribed by ordinance, any person, firm, or corporation, who shall commit an offense, or violate any section of this code or charter provision, or any subsequent ordinance of the city, shall upon conviction be fined in an amount not to exceed five hundred dollars ($500.00) plus court costs, the fees and mileage of witnesses, if any, and any other fees, assessments or costs imposed by Oklahoma Statutes to be collected by the Okmulgee municipal court, including, but not limited to, a separate penalty assessment and a fingerprinting fee. Provided, that the municipal court shall not impose a penalty for any conviction that is in excess of the maximum penalty available in district court upon conviction for the same offense.
   B.   Any person convicted of a misdemeanor offense, including misdemeanor traffic offenses but excluding parking and standing violations, punishable by a fine of ten dollars ($10.00) or more or by incarceration or any person forfeiting bond when charged with such an offense, shall be ordered by the Okmulgee municipal court to pay nine dollars ($9.00) to the city as a separate penalty assessment for each offense as required under 20 Oklahoma Statutes section 1313.2.
   C.   In addition to the separate penalty assessments imposed by subsections B, D and E of this section, any person convicted of any offense, including traffic offenses but excluding parking and standing violations, punishable by a fine of ten dollars ($10.00) or more or by incarceration or any person forfeiting bond when charged with such offense, shall be ordered by the Okmulgee municipal court to pay a fingerprinting fee to the city in the amount of five dollars ($5.00) for each offense as required under 20 Oklahoma Statutes section 1313.3.
   D.   In addition to the separate penalty assessment imposed by subsection B of this section and in addition to the fingerprinting fee imposed by subsection C of this section, any person convicted of any offense, including traffic offenses but excluding parking and standing violations, punishable by a fine of ten dollars ($10.00) or more or by incarceration or any person forfeiting bond when charged with such offense, shall be ordered by the Okmulgee municipal court to pay a forensic science improvement assessment fee to the city in the amount of five dollars ($5.00) for each offense as required under 20 Oklahoma Statutes section 1313.4.
   E.   In addition to the separate penalty assessment imposed by subsection B of this section, the fingerprinting fee imposed by subsection C of this section and the forensic science improvement assessment fee imposed by subsection D of this section, any person convicted of any misdemeanor offense, excluding traffic offenses and parking and standing misdemeanor violations, but including misdemeanor violations of 47 Oklahoma Statutes section 11-902 (driving under the influence of alcohol or drugs), punishable by a fine of ten dollars ($10.00) or more or by incarceration or any person forfeiting bond when charged with such misdemeanor offense, shall be ordered by the Okmulgee municipal court to pay a medical expense liability fee in the amount of ten dollars ($10.00) for each misdemeanor offense, to the city, as required under 20 Oklahoma Statutes section 1313.7. The medical expense liability fee shall be in addition to and not in substitution for any and all fines and penalties otherwise provided for by law for such offense as provided in 20 Oklahoma Statutes section 1313.7.
   F.   Any person, firm, or corporation, who shall:
      1.   Commit an offense, or violate any section of this code relating to assault, battery, driving under a suspended driver's license, selling or delivering alcohol to a minor, driving while intoxicated, leaving the scene of an accident, eluding the police, pimping or prostitution, and
      2.   Having been previously convicted of a violation of the same provision of this code within ten (10) years of the most recent allegation,
may be charged as a repeat offender, and shall upon conviction be fined in an amount not less than four hundred dollars ($400.00) nor more than seven hundred fifty dollars ($750.00) plus court costs, the fees and mileage of witnesses, if any, and any other fees, assessments or costs imposed by Oklahoma Statutes to be collected by the Okmulgee municipal court. However, the municipal court shall not impose a penalty for any conviction that is in excess of the maximum penalty available in district court upon conviction for the same offense.
