7-2-1: EXCAVATION PERMIT AND INSPECTION:
   A.   Permit, Application And Deposit:
      1.   Permit Required: It is unlawful for any person, firm or corporation to make an opening in a street or sidewalk without a permit as provided herein.
      2.   Application For Permit; Payment Of Inspection Fee:
         a.   Any person, firm or corporation desiring to make an opening in a public street or sidewalk of the city is hereby required to make written application with the city clerk for permit to make such opening, and shall be required to pay the fee as set by the city council to the city clerk as an inspection fee. (1985 Code § 14-401)
         b.   The city clerk shall transmit the application to the city manager, who shall issue a permit therefor, if he thinks the request reasonable under the circumstances, and that the street or sidewalk will be properly and promptly restored. If the city manager refuses a permit, the applicant may appeal within thirty (30) days to the city council; and the city manager shall issue the permit if the council approves the application. The council's decision shall be final.
      3.   Deposit For Street Restoration: Before the permit is issued, either the city manager or the council may require the applicant to deposit with the city clerk an amount of money estimated by the city manager or council to be adequate to compensate the city for restoring the street or sidewalk properly if the applicant fails to do so promptly. If the applicant restores the street or sidewalk promptly and properly, the amount deposited shall be returned to him. (1985 Code § 14-401; amd. 2007 Code)
   B.   Restoration; Inspection And Fee:
      1.   Requirements:
         a.   After the person, firm or corporation has made such opening in the public streets or sidewalks, the same shall be replaced in such manner as may be prescribed by the city manager.
         b.   After such replacement has been made, the person, firm or corporation making the opening in the street or sidewalk shall notify the office of the city clerk that the same is ready for inspection. Within twenty four (24) hours after such notification, excluding Saturdays, Sundays and holidays, the city manager or such person as is designated by the city manager shall inspect such replacement and either approve or reject the same. If the same is rejected as not having conformed to the rules and regulations prescribed by the city, such rejection shall be communicated to the person having made the replacement in conformity with the rules and regulations prescribed by the city.       2.   Inspection Fee: The inspection fee which is required shall go into the general fund of the city. (1985 Code § 14-403)
