(A) Establishment of Commission, name and membership.
(1) A Commission is hereby established for the purpose of managing, administering and directing disbursements of money received and accepted from gifts, grants, donations, contributions and/or bequests designed by donors thereof to be used for the County Health Department.
(2) The Commission shall be known as the “Health Department Donations Commission,” and shall consist of members, each of whom shall be the members of the county’s Board of Health.
(B) Compensation. Members of the Health Department Donations Commission shall not receive a salary or other compensation for the performance of their respective duties.
(C) Establishment of receipts line item within Donations Fund.
(1) A receipts line item shall be established within a Donations Fund maintained by the County Auditor for the purpose of accounting for money received from gifts, grants, donations, contributions and/or bequests designated to be used for the county’s Health Department, which are accepted by the Health Department Donations Commission. The County Auditor shall deposit in said Donations Fund all amounts received for such purposes and accepted by the Health Department Donations Commission, and shall keep a record of such amounts received and disbursed in said receipts line item established for such purposes.
(2) The County Auditor shall issue a warrant directing the County Treasurer to disburse money from said Fund only upon the written direction and authority of the Health Department Donations Commission.
(D) Powers of Commission. The Health Department Donations Commission may accept gifts, grants, donations, contributions and/or bequests from any public or private source for the uses and purposes designated by the donors thereof to be used for the county’s Health Department, which the Commission may consider appropriate, necessary or desirable. The Commission shall receive and approve, alter or reject requests and proposals for the use of money received and accepted for such purposes.
(E) Receipts and disbursements of money. All money received and accepted by the Health Department Donations Fund Commission shall be deposited, held, secured and paid without appropriation upon approval of the Health Department Donations Commission. The handling and expenditure of such money shall be subject to audit and supervision by the state’s Board of Accounts.
