Prior to receiving a dedication of land or a cash contribution in lieu of land, pursuant to this division, the board of education shall adopt a resolution indicating its desire to receive the dedications and/or contributions required by these regulations, and shall execute an intergovernmental agreement with the county in which the school district agrees to indemnify and hold the county harmless, including the cost of attorney fees, from all suits filed in which the validity or application of this division is challenged.
