The purpose of this administrative policy is to set forth a procedure for notice and collection of reimbursement for federal civil penalties on the airport. Title 8, chapter 6 of the Ogden municipal code provides for reimbursement for all expenses incurred by the city due to the actions of any airport user. Similar provisions are found in airport leases and contracts, as well as security badge applications. Pursuant to federal law, Ogden City as an airport sponsor is required to adopt an airport security plan and ensure its users comply with all federal, state and local laws and regulations related to security and operations of a federally subsidized airport. The transportation security administration (TSA) and the federal aviation administration (FAA) require Ogden City to enforce all security and operational laws and regulations against airport users to ensure compliance. TSA and FAA are empowered to impose fines and penalties against Ogden City for the security and operational violations of airport operators, tenants and users and their employees, invitees and agents. The purpose of such federal penalties is to induce strict compliance with federal, state and local security and operational laws and regulations by all airport operators, tenants and users. To further that purpose, and to avoid city liability for the misconduct of others, any federal civil penalty should become the responsibility of those individuals and entities whose actions or inaction caused the civil penalty.
