2010-3: WAIVER, INDEMNITY AND RELEASE:
   A.   All skydivers jumping on the airport, including tandem jumpers, must sign a waiver, indemnity and release of liability of the city and its officers, employees, agents and volunteers, in a format approved by the city attorney, which must be delivered to the office of the airport manager prior to their jump, except a commercial skydiving operator may preserve and maintain the waiver, indemnity and release of liability and provide a copy to the airport manager as provided below.
   B.   A commercial aeronautical airport operator shall not assist any skydiver to jump onto the airport unless it first obtains from the skydiver the waiver, indemnity and release of liability described in subsection A of this section.
   C.   A commercial skydiving operator shall be deemed to have complied with subsections A and B of this section, if it:
      1.   Delivers to the office of the airport manager a scanned copy of the fully executed waiver, indemnity and release of liability required hereinabove by e-mailing it to the office of the airport manager no later than one calendar week after execution, via an e-mail address provided by the airport manager for that purpose; and
      2.   Preserves and maintains the original executed waiver, indemnity and release of liability for not less than five (5) years after execution, making it available for inspection or duplication by the airport manager upon request.
   D.   A fully executed and delivered waiver, indemnity and release of liability shall be sufficient for all skydiving jumps made by a skydiver upon the airport for one year from the date of execution, after which a renewed waiver, indemnity and release must be executed for each additional year thereafter. Notwithstanding this one year renewal requirement, nothing in this policy shall extinguish the enduring force and effect of a waiver, indemnity and release of liability beyond one year from its execution date.
   E.   A commercial skydiving airport operator shall maintain records demonstrating that all of its skydiving clients, instructors, employees and contractors are in compliance with this policy. Such records shall be made available for inspection by the airport manager during business hours, upon reasonable prior notice. (Eff. 7-26-2016)
