The following rules and regulations are adopted for all City parks and park facilities, including trails and the Ogden River Parkway and Weber River Parkway:
   A.   Smoking: No smoking of any kind, including the use of electronic cigarettes, is permitted.
   B.   Alcohol:
      1.   As defined in Ogden Municipal Code section 11-5-1, no person shall consume an "alcoholic beverage", or keep, carry or possess any "open container" containing an alcoholic beverage within a City park, except when consumption occurs as part of a concession authorized by Ogden City and the beverage is consumed within the park.
      2.   No person shall be under the influence of alcohol, a controlled substance, or any substance having the property of releasing toxic vapors, to a degree that the person may endanger themselves or another within a City park.
   C.   Glass: Glass containers are not allowed.
   D.   Animals: Unless specifically posted otherwise or as part of a special event or other permitted activity, animals shall be adequately restrained at all times and shall not be permitted to run at large.
   E.   Hours Of Operation: As provided in section 11-3-2 of the Municipal Code, all parks and trails are closed to the public from one hour after sunset to one hour before sunrise, except when participating in or attending an activity sponsored by the City or allowed under a special event permit issued by the City.
   F.   Littering: No person shall throw, deposit, place, or discard litter in any manner, except in containers or areas lawfully provided therefor. No person shall expectorate, or urinate or defecate except into a toilet for that purpose.
   G.   Camping And Sleeping: Except when permission has been granted by the Mayor for a permitted special event:
      1.   Camping is not allowed at any time;
      2.   No person shall remain in any park for the purpose of sleeping between the hours of eight thirty o'clock (8:30) P.M. and eight thirty o'clock (8:30) A.M.; and
      3.   It is a separate violation of these rules for a person camping or sleeping in violation of subsection G1 or G2 of this section to fail to remove any shelter, camping or sleeping equipment, or personal items from the park within five (5) minutes after being requested to do so.
   H.   Noise: Making excessive, unnecessary, unusually loud, or amplified noises in violation of Ogden Municipal Code title 12, chapter 14 is not allowed, unless a special permit has been issued pursuant to section 12-14-8 of the Ogden Municipal Code.
   I.   Nuisances:
      1.   No person shall create any nuisance, or commit any offense that is in violation of State law or City ordinance;
      2.   Except for City employees acting in the scope of their duties, no person shall scratch, cut, injure or deface any of the buildings, fences, structures or other property; foul any of the fountains or any other improvements; cut or injure flowers, flowerbeds, or other landscaping; create or utilize any path or shortcut other than a City designated path in any garden or landscaped area, other than to cross an open lawn area; engage in any activity which tends to damage any landscaping, structure or equipment; or attach ropes, straps, wires or similar devices to trees or structures, including for use in tethering animals, slacklining, or hanging hammocks.
   J.   Obstructing Walkways And Paths: It is unlawful for any person to remain standing, lying or sitting on any walkway or path for a longer period than two (2) minutes in such a manner as to obstruct the free passage of foot travelers thereon.
   K.   Posted Orders: No person shall enter any area designated by signs as a rehabilitation or restoration area, or violate any provision or instruction on any sign, except enforcement or parks maintenance personnel in furtherance of their duties.
   L.   Fires: A person may not light, build, or maintain a fire, except in a device provided, maintained, and designated by the City for that purpose.
   M.   Bathing: No fountain, river, stream, pool, sink or other fixture not specifically designated for such purpose shall be used by any person for the purpose of bathing, shaving or washing clothing.
   N.   Fireworks: A person may not discharge any kind of firework, except by permit.
   O.   Sale Of Goods And Things: No person shall bring, or cause to be brought, for the purposes of sale, barter or advertising; or have for sale, or sell or exchange; or offer for sale or exchange - any goods, wares, motor vehicles, or merchandise in any parking area, park, trail or trailhead without first having obtained a permit, concession, license or lease from Ogden City.
   P.   Parking Of Semis: No parking of semi-tractors or trailers is allowed on park property or trailhead, including parking areas, unless part of a special event for which a permit has been obtained.
   Q.   Implementation: This policy shall be implemented consistent with applicable City ordinances and policies and Utah and Federal law. (Eff. 9-8-2017)
