Any owner may be required to reattend the city crime-free rental housing program seminar after two years if the crime-free rental housing coordinator recommends reattendance. The city, in determining whether or not to have the person reattend the crime-free rental housing program seminar shall consider the following:
   (A)   If the rental housing is at a substantial risk of becoming a nuisance residential rental property as defined in this chapter; or
   (B)   Criminal activity is occurring on the premises and the owner has failed to initiate eviction proceedings.
