(a) Program Creation. The Obetz Utility Payment Program (the "Program") is hereby created.
(b) Applicability. The Program is applicable only to the Village-operated water, sewer, and refuse utilities (the "Utility Services").
(c) Applying for Assistance. Any water, sewer, or refuse customer may apply for assistance under the Program provided they meet the following conditions:
(1) The Utility Service(s) must be at risk of disconnection for failure to timely pay as required by Village Ordinances.
(2) The customer may not participate in the Program more than one (1) time in any three (three) year period.
(3) The customer must submit an application, including all information required therein, and gain approval from the Village Administrator to participate in the Program.
(d) Calculating the Payments. The Program allows customers, when approved, to pay the customer's regularly occurring bills; and, to spread the amount subject to the repayment plan over four months. For example, a Program participant with a $1,000 balance as of April 30th who is approved to participate in the Program during the month of April would pay:

(e) Agreement Required. Each Program participant shall execute an agreement with the Village promising to make the required payments under the Program.
(f) Start of Repayment. The customer shall begin making the required Program payments the month after the application to participate in the Program is approved by the Administrator.
(g) Late Payments. If the participant is late with a payment under the Program, the Village shall disconnect the participant's utility services, at a time convenient for the Village. At the time the Utility Services are disconnected, the full outstanding utility balance shall become due and payable. The customer shall pay the full outstanding utility balance before the Village will restore service.
(h) Disconnection Due to Violation of Other Rules or Laws. Participation in the Program will not prevent the Village from disconnecting a participant's utility services for the violation of any other rule or law established by the Village relating to the water, sewer, or refuse utilities.
