947.11 FORCE MAJEURE.
   Except as specifically provided to the contrary herein, inability or failure of The Village of Obetz, Ohio and /or its upstream natural gas suppliers to deliver natural gas or of either party to perform pursuant to this chapter will not be the basis of claims for damages sustained by the Customer receiving natural gas service or for breach of contract when due to causes or contingencies reasonably beyond the control of The Village of Obetz, Ohio, including but not limited to Acts of God or governmental authority; the elements; labor disputes; fires, accidents, breakage, repair or change of or obstruction in pipelines, equipment or machinery; fluctuations in gas pressure, or demands in excess of the capacity of transporter's equipment or pipelines. The Village of Obetz, Ohio shall give notice of such event of force majeure in reasonably full particulars to its Customers, as soon as reasonably possible. Any such event of force majeure shall, so far as possible, be remedied with all reasonable dispatch. The obligations to make payments due hereunder will not be suspended due to force majeure conditions.
