In addition to the charges imposed by this chapter, the following service fees are hereby established:
(a) Gas Main Extension Charges.
(1) The Administrator is authorized to provide gas service to new consumers when he determines that the gas main extension is feasible both economically and from an engineering point of view and will not be detrimental to the best interest of the Village of Obetz, Ohio having given consideration to the overall effect on the total gas system and to the long term plans and probable future growth of the gas system of the Village of Obetz, Ohio. All such action is subject to Council approval.
(2) The applicants or developer requesting such extension shall pay for gas main extensions in the Village of Obetz, Ohio unless otherwise agreed to in writing.
(3) When the Village of Obetz, Ohio installs gas main extensions, the cost may be assessed against the abutting property owners, with the approval of Council. Such assessment shall be in an amount equal to the total installation cost. The costs shall be determined as prescribed herein.
(4) The Administrator shall prepare the specifications and standards of construction for all gas main extensions. Plans and installation shall be subject to approval of the professional engineer representative of the Administrator and subject to Council approval.
(5) The size of all gas mains shall be determined by the Administrator or his designated representative and shall be large enough not only to serve the areas under immediate consideration but also to serve areas which are likely to be developed and which should be served by the gas main under construction and in accordance to recommendations of the Administrator or Council. Unless otherwise required by the Administrator, no gas main shall be smaller than two inches nominal diameter.
(6) All extensions of gas mains shall include the installation of all taps and valves. The number and location of all taps and valves shall be as required by the Administrator.
(7) All gas mains and appurtenances shall be owned, operated and maintained by the Village of Obetz, Ohio, with title to be vested in the Village of Obetz, Ohio upon completion of the gas main. All public gas lines shall lie on public easements or rights of way.
(8) Private developers or concerns shall install no gas mains unless authorized by an agreement between the Village of Obetz, Ohio and the developer or applicants. Where a developer or applicants who abut on parcels not owned by the developer or applicants, nor which have been included in the agreement install gas mains, the developer or applicants shall be entitled to reimbursement when such parcels are connected to the gas main. Such connections shall be made within ten years from the completion of the gas main construction to be considered for such reimbursement. This reimbursement, minus an administrative fee, will be paid to the developer from the funds collected by the Village of Obetz, Ohio for such connections. The amount of the reimbursement shall be determined by dividing the cost of the gas main paid by the developer or applicants by the available frontage abutting the public right of way where the improvements have been made. To be eligible for this reimbursement, the developer or applicants must file with the Village Administrator the standards and specifications, receipts for all labor and material used in connection with the construction of the gas main, together with final, as-built plans, properly referenced for future location of the work. The Superintendent must receive this information within ninety days of completion of the gas main or at such further time that may be authorized by the Administrator.
(9) The connection or extension fee shall be paid in full to the Village of Obetz, Ohio before a gas tap is authorized and the connection is made.
(b) Involuntary Disconnection: Reconnection Fee. In the event gas service to customers under Schedule "CS" is involuntarily discontinued for any reason other than the Village of Obetz, Ohio's inability to serve, the Village of Obetz, Ohio shall be under no obligation to restore service at that location until the Village of Obetz, Ohio first receives payment of a reconnection fee which is equal to the sum of the monthly customer service charge for each of the months between the time the service was discontinued and the time service is restored up to a maximum of twelve monthly customer charges, any remaining payments due for service provided prior to the discontinuation of service, and the service turn-on fee as set forth in this section.
(c) Voluntary Disconnection: Reconnection Fee. In the event gas service to customers under Schedule "CS" is voluntarily discontinued for any reason, the Village of Obetz, Ohio shall be under no obligation to restore service at that location until the Village of Obetz, Ohio first receives payment of a reconnection fee which is equal to the sum of the monthly customer service charge for each of the months between the time the service was discontinued and the time service is restored up to a maximum of twelve monthly customer charges, any remaining payments due for service provided prior to the discontinuation of service, and fifty dollars ($50.00).
(d) Service Turn-on Fee. A service turn-on fee of fifty dollars ($50.00) shall be charged to each new customer under Schedule “CS” and included in the initial service bill. This fee shall also be charged to customers requesting reconnection subsequent to an involuntary disconnection as set forth in this section.
