2-1-9: HISTORIC DESIGNATION:
   A.   Nomination And Consideration Of Buildings, Districts, Landmarks And Structures For Official Historic Designation:
      1.   Initiation Of Nomination: Nomination of any building, district, landmark or structure for consideration for official historic designation shall be submitted to the Commission on a form prepared by the Commission, and may be submitted by any of the following:
         a.   A member of the Zoning and Planning Commission;
         b.   A member of the Village Board;
         c.   Any resident of the Village;
         d.   The owner(s) of record of the building, district, landmark or structure in question.
      2.   Notification Of Nomination And Public Hearing:
         a.   Where the owner(s) of record of the building, district, landmark or structure subject to the nomination is/are not the applicant(s), said owner(s) of record shall be notified, by regular mail, of the nomination. In such event, no public hearing shall he held in regard to said nomination without the prior written consent of the owner(s) of record.
         b.   Where the owner(s) of record is/are the applicant(s) or has/have consented to the nomination pursuant to subsection A1 above, the Commission shall schedule a public hearing on the nomination within forty-five (45) days following receipt of the completed nomination form and the owner(s) of record’s consent. Notice of such public hearing shall be given by the Commission and the petitioner at least fifteen (15) days prior thereto by the following methods:
            i.   By requiring that the petitioners post a notice of the public hearing on the subject property(ies) in a position conspicuously visible and readable from the street, on a sign of not less than twenty two inches (22") by twenty eight inches (28"), setting forth the time, date and place of the public hearing, including the common name and address for the building, landmark or structure or the common boundaries of the District, which is the subject matter of the public hearing.
            ii.   By mailing a copy of the notice referenced in subsection A2bi above to every person, firm or corporation that has registered with the Commission for purposes of receiving said notices.
            iii.   By mailing a copy of the notice referenced in subsection A2bi above to the taxpayer of record for each lot, tract or parcel which abuts the subject property or is separated from the subject property by only an alley or street right of way.
All mailings required by this subsection shall be by first class U.S. mail, with the Village staff member or Commission member who performs any such mailing executing an affidavit as to the mailing having been performed in compliance herewith.
      3.   Hearing Procedures: The hearing shall be conducted in accordance with the rules of the Commission. The Commission shall consider all testimony or evidence relating to the designation criteria, as set forth in Section 6-16-7 of this Chapter, from any person who makes written submission or appears at the public hearing.
      4.   Recommendation By The Commission: Within thirty five (35) days following the close of the public hearing, the Commission shall make a determination upon the evidence as to whether the nominated building, district, landmark or structure does or does not meet the criteria for official historic designation. If the Commission determines that the nominated building, district, landmark or structure does meet the criteria for official historic designation, the Commission shall forward its recommendation to the Village Board. Such a recommendation shall be approved by a roll call vote of the Commission and shall be accompanied by a report to the Village Board setting forth the Commission’s findings of fact relative to the recommendation. Said report shall be accompanied by a map showing the location of the nominated building, landmark or structure, or the boundaries of the nominated district.
      5.   Notification To The Nominator And Owner(s) Of Record: Notice of the recommendation of the Commission, including a copy of the report, shall be sent by regular mail to the nominator(s), and the owner(s) of the record if other than nominator(s), within five (5) days after the recommendation is approved by the Commission. Said notification shall also set forth the Village Board meeting at which said recommendation will be discussed.
      6.   Official Historic Designation By The Village Board:
         a.   The Village Board shall, within thirty (30) days after receiving the recommendation and report of the Commission regarding the nominated building, district, landmark or structure, either approve of official historic designation for said building, district, landmark or structure by ordinance, or reject designation by motion.
         b.   Failure of the Village Board to take action on the Commission’s recommendation within said thirty (30) day period shall be deemed to be a rejection of the recommendation.
         c.   A certified copy of any ordinance adopted pursuant to subsection F1 above shall be sent by regular mail to the nominator(s), and to the owner(s) of record if any other than the nominator(s). A copy of said ordinance shall also be filed with the Zoning and Planning Commission and the Village Building Department.
         d.   If the Village rejects the recommendation of the Commission, the Commission may not reconsider the nominated building, district, landmark or structure for official historic designation for a period of one year from the date of the Village Board’s rejection of the designation unless:
            i.   Significant new information concerning the previously nominated building, district, landmark or structure, relating to the criteria for official historic designation, is provided, and
            ii.   The Commission votes by an affirmative vote of at least five (5) Commissioners to reconsider the previously nominated building, district, landmark or structure.
   B.   Criteria For Official Historic Designation: Every nominated building, district, landmark or structure must exhibit one or more of the following specified criteria to receive a recommendation from the Commission for official historic designation:
      1.   Its location as a site of a significant historic event or activity which may or may not have taken place within or involved the use of any existing improvements on the property;
      2.   Its identification with a person or persons who significantly contributed to the cultural, architectural or economic development of the Village, State, Midwest region or the United States;
      3.   Its exemplification of an architectural type, style or design distinguished by innovation, rarity, uniqueness or overall quality or design, materials or craftsmanship;
      4.   Its identification as the work of an architect, designer, engineer or builder whose individual work is significant in the development of the Village, State, Midwest region or the United States;
      5.   Its exemplification of important planning and urban design techniques distinguished by innovation, rarity, uniqueness or overall quality of design or detail;
      6.   Its association with important cultural or social aspects or events in the history of the Village, State, Midwest region or the United States;
      7.   Its representation of a historic theme expressed through distinctive buildings, landmarks or structures;
      8.   Its unique location or distinctive physical appearance or presence representing an established and familiar visual feature of a neighborhood, community or the Village; or
      9.   Its exemplification of a pattern of neighborhood development or settlement significant to the traditions of the Village, whose components may lack individual distinction.
   C.   Effect Of Official Historic Designation: Once approved for official historic designation, no historic building, landmark or structure, or building, landmark or structure within a historic district, may be subjected to alteration or demolition without the prior approval of the commission.
   D.   Official Historic Designation:
      1.   The following Historic Districts have received official historic designation by the Village Board pursuant to the provisions of this Chapter 2: none.
      2.   The following historic buildings, landmarks and/or structures have received official historic designation by the Village Board pursuant to the provisions of this Chapter 2: none. (Ord. 21-19-86)
