3-1-1-12: ENFORCEMENT AND PENALTIES:
   A.   Enforcement: It shall be the duty of the Village Manager to administer and enforce the terms and provisions of this section 3-1-1, and to make or cause to be made such inspections of buildings or premises as may be necessary to accomplish such administration or enforcement. The Village Manager is authorized to order a business closed, in whole or in part:
      1.   Engaging in unlicensed business activity, until all the required licenses are obtained, or
      2.   Failing to pay any required license fee or to renew a license. The Village Manager shall issue a 10-day notice of violation before any closure under this subsection (a)(2) may take place. For the purposes of this Chapter, a business that has been issued a cease-and-desist order for a particular business activity shall be considered closed as to that business activity.
If the Village Manager orders a business closed, whether in its entirety or as to one or more business activities, the Village Manager shall have a notice or sign posted on the licensed premises indicating that the business is closed in its entirety or as to specific business activities and is prohibited from engaging in them. No person shall remove any such notice or sign unless and until the business reopens, whether in its entirety or as to the closed business activities, in compliance with the Code.
   B.   Penalties:
      1.   General: Any person violating any provision of this section 3-1-1, that does not result in closure of the business, shall be fined an amount not less than twenty five dollars ($25.00) nor more than seven hundred fifty dollars ($750.00) for each offense; and a separate offense shall be deemed committed on each day during or on which a violation occurs or continues.
      2.   Business Closure: Any person who continues to operate a business which has been closed, in whole or in part, by the Village Manager pursuant to this section shall be subject to a fine of not less than $500.00 nor more than $1,000.00 for each offense. Each day that a violation continues shall constitute a separate and distinct offense. In addition to any other penalty provided by law, such violation may also be punishable as a misdemeanor by incarceration in the county jail for a term not to exceed six months under the procedures set forth in Section 1-2-1.1 of the Illinois Municipal Code and under the provisions of the Illinois Code of Criminal Procedure.
      3.   Certificate Renewals: A grace period of thirty (30) days begins on May 1 of each year for the renewal of business certificates. If a commercial establishment fails to renew its business certificate by May 30 of each year, an additional fee equal to twenty five percent (25%) of the base fee shall be charged for each month after May 30. Delinquency may also result in suspension and/or revocation of the right to conduct commercial activities within the Village.
