A. Possession Of Drug Paraphernalia: Except as otherwise provided in the Cannabis Regulation and Tax Act (410 ILCS 705/1-1 et seq.) or the Compassionate Use of Medical Cannabis Program Act (410 ILCS 130/1 et seq.), it is unlawful for any person to use, or to possess with intent to use, drug paraphernalia to plant, propagate, cultivate, grow, harvest, manufacture, compound, convert, produce, process, prepare, test, analyze, pack, repack, store, contain, conceal, inject, ingest, inhale, or otherwise introduce into the human body a controlled substance in violation of the Illinois controlled substances act or the Illinois cannabis act. Any person who violates this subsection is guilty of a violation of this section 10-5-4, and upon conviction may be fined not less than one hundred dollars ($100) nor not more than seven hundred fifty dollars ($750.00).
B. Manufacture, Delivery Or Sale Of Drug Paraphernalia: Except as otherwise provided in the Cannabis Regulation and Tax Act (410 ILCS 705/1-1 et seq.) or the Compassionate Use of Medical Cannabis Program Act (410 ILCS 130/1 et seq.), it is unlawful for any person to deliver, possess with intent to deliver, manufacture with intent to deliver, sell, possess with intent to sell, or buy drug paraphernalia, knowing, or under circumstances where one reasonably should know, that it will be used to plant, propagate, cultivate, grow, harvest, manufacture, compound, convert, produce, process, prepare, test, analyze, pack, repack, store, contain, conceal, inject, ingest, inhale, or otherwise introduce into the human body a controlled substance in violation of the Illinois controlled substances act, or the Illinois cannabis control act. Any person who violates this subsection is guilty of a violation of this section 10-5-4 and upon conviction may be fined not less than one hundred dollars ($100) nor not more than seven hundred fifty dollars ($750.00).
C. Delivery Of Drug Paraphernalia To A Minor: Any person eighteen (18) years of age or over who violates subsection B of this section by delivering or selling drug paraphernalia to a person under twenty-one (21) years of age is guilty of a special offense and upon conviction may be fined not less than one hundred dollars ($100) nor not more than seven hundred fifty dollars ($750.00).
