Requests for zoning interpretations
H. All applications for a variation from any of the provisions of title 4, 5 or 6 of this code, when said variation is requested after the commencement of construction of any structure or building, or addition thereto, on the property in question (a "construction necessitated variation"), shall be accompanied by a filing fee of five hundred dollars ($500.00), or a filing fee of five thousand dollars ($5,000.00) if the application relates to a second or further request for a construction necessitated variation within a twenty four (24) month period. In the event the petitioner for said variation is the property owner, and said petitioner can show by clear and convincing evidence that said petitioner relied upon a third party (e.g., a contractor) who represented to the petitioner that said third party would be responsible for petitioning for and obtaining any required variation, said petitioner may request, and the village board may grant, a refund of that portion of the five hundred dollar ($500.00) or five thousand dollar ($5,000.00) filing fee, as the case may be, in excess of the normal filing fee for said variation petition. In addition, any contractor working on a site which requires a construction necessitated variation shall, for the twenty four (24) month period following the petition filing date, be required to have a staked survey performed relative to any site in relation to which the contractor is performing work that involves the construction of a building, accessory building or structure, or any addition thereto, and where said construction involves any increase in the lot coverage, prior to the issuance of any building permits in relation to said work.
I. In addition to the fees set forth in subsections B through H of this section, the applicant shall be responsible for the payment of any newspaper notice publication costs and surrounding property owner notification costs connected with the applicant's appearance before the Zoning and Planning Commission. In relation thereto, the applicant shall be charged, in addition to the filing fees set forth in subsections B through H of this section, a fifty dollar ($50.00) newspaper notice publication/surrounding property owner notification fee, if the applicant's request requires a newspaper notice/surrounding property owner notice. If said amount exceeds the actual cost of said notices, a refund shall be issued to the applicant. If said amount is insufficient to cover the actual cost of said notices, the applicant shall be required to pay the difference. The Zoning and Planning Commission shall not proceed with regard to the applicant's request until the Department of Community Development and Growth Management has confirmed that said newspaper notice publication costs and surrounding property owner notification costs have been paid by the applicant.
