7-6-1: DEFINITIONS:
As used in this chapter, the following terms shall have the meanings ascribed to them in this section:
EMERGENCY ACTION: Any action taken at or near the scene of a hazardous materials emergency incident to prevent or minimize harm to human health, to property, or to the environment from the unintentional release of a hazardous material.
EMERGENCY RESPONSE AGENCY: A unit of local government or volunteer fire protection organization that provides:
   A.   Firefighting services;
   B.   Emergency rescue services;
   C.   Emergency medical services;
   D.   Hazardous materials response teams;
   E.   Civil defense; or
   F.   Technical rescue teams.
HAZARDOUS MATERIAL: A substance or material in a quantity and form determined by the United States department of transportation to be capable of posing an unreasonable risk to health and safety or property when transported in commerce.
RESPONSIBLE PARTY: A person who:
   A.   Owns or has custody of hazardous material that is involved in an incident requiring emergency action by an emergency response agency; or
   B.   Owns or has custody of bulk or nonbulk packaging or a transport vehicle that contains hazardous material that is involved in an incident requiring emergency action by an emergency response agency; and
   C.   Causes or substantially contributed to the cause of the incident. (Ord. 05-22-82)
