A. Code Adopted:
1. International Code Adopted: The International Fire Code 2018, and its appendices A, B, C and D, is adopted as the "Fire Code for the Village of Oak Lawn", for the control of buildings and structures as provided; and each and all of the regulations, provisions, penalties, conditions and terms of said International Fire Code 2018, are adopted and made a part hereof, as if fully set out in this code with the additions, insertions, deletions and changes prescribed in this chapter.
Reference in this chapter to "this code" is a reference to the International Fire Code, 2018, and such reference includes that document and any amendments, or supplements thereto. References in this code to "the building code" shall mean the adopted "building code for the village of Oak Lawn" as set forth in section 6-1D-1
of this code.
2. State Adopted Code: Pursuant to the Fire Investigation Act, 425 ILCS 25/0.01 et seq. 1 , the Illinois office of the state fire marshal has adopted the National Fire Protection Association Life Safety Code, 2000 edition, as the “Fire Code for the State of Illinois” serving as the state's minimum level of fire prevention and safety. This adoption is made at 41 Illinois administrative code 100. In conjunction with the authority granted by the fire investigation act, NFPA Life Safety Code, 2000 edition, is the minimum requirement that must be met statewide in Illinois.
The NFPA Life Safety Code, 2000 edition, is applicable statewide in all occupancy classifications. The village of Oak Lawn shall enforce as a minimum the NFPA life safety code requirements or the International Fire Code , 2018, requirements that are equivalent to, or more stringent than, those imposed by the Illinois OSFM adopted code.
B. Amendments To Code: The International Fire Code, 2018, is amended and changed as follows:
SECTION 101 SCOPE AND GENERAL REQUIREMENTS
1. [A] 101.1 Title.
Replace the language of the Code with the following, "These regulations shall be known as the Fire Code of the Village of Oak Lawn and hereinafter referred to as 'this code'."
2. Add Section 102.7.1 Conflicting code information.
Where any provision of International Fire Code 2018, conflict with any provisions of this Village Code, the provisions of the Village Code shall prevail and shall be applied as law of the Village.
SECTION 103 DEPARTMENT OF FIRE PREVENTION
3. [A] 103.2 Appointment.
Add the following language at the end of the first sentence, "and shall be the designated authority charged with the administration and enforcement of the code, or a duly authorized representative.
SECTION 105 PERMITS
4. [A] 105.4.6 Retention of construction documents.
Add the following language in the first sentence after Fire Code official, "or building official"
Delete the following language, "shall be returned to the applicant, and said set"
SECTION 106 FEES
5. [A] 106.2 Schedule of permit fees.
A fee for each permit shall be paid as required, in accordance with the schedule as established by the applicable governing authority.

SECTION 110 VIOLATIONS
6. [A] 110.4 Violation penalties.
Change the language to read as follows: "Persons who shall violate a provision of this code or shall fail to comply with any of the requirements thereof or who shall erect, install, alter, repair or do work in violation of the approved construction documents or directive of the fire code official, or of a permit or certificate used under provisions of this code, shall be guilty of a [SPECIFY OFFENSE], a misdemeanor, punishable by a fine of not less than one hundred dollars ($100.00) and not more than [AMOUNT] seven hundred fifty dollars ($750) or by imprisonment not exceeding [NUMBER OF DAYS] one hundred eighty (180) days for each offense, or both such fine and imprisonment. Each day that a violation continues after due notice has been served shall be deemed a separate offense (VOL 1-4-1).
The application of the above penalty shall not be held to prevent the enforced removal of prohibited conditions."
SECTION 112 STOP WORK ORDER
7. [A] 112.4 Failure to comply.
Change the language to read as follows: "Any person who shall continue any work after having been served with a stop work order, except such work as that person is directed to perform to remove a violation or unsafe condition, shall be liable to a fine of not less than [AMOUNT] dollars or more than [AMOUNT] dollars. not less than one hundred dollars ($100.00) and not more than seven hundred fifty dollars ($750).
The application of the above penalty shall not be held to prevent the enforced removal of prohibited conditions."
SECTION 307 OPEN BURNING, RECREATIONAL FIRES AND PORTABLE OUTDOOR FIREPLACES
8. 307.2 Permit required.
Add the following language, "Completed application and copies of permits obtained from all appropriate state and local governmental agencies shall be provided to the fire code official no less than ten (10) business days prior to the event."
9. 307.2.1 Authorization.
Delete current Code language and replace with the following, "Authorization shall be obtained from all appropriate state and local governmental agencies including, but not limited to, Illinois Environmental Protection Agency, Cook County Department of Environmental Control, the Oak Lawn Fire Department, the Oak Lawn Park District (Wolfe Wildlife Refuge). Copies of permits obtained from all appropriate state and local governmental agencies shall be provided to the Oak Lawn Fire Department no less than ten (10) business days prior to the event."
10. 307.3 Extinguishment authority.
Delete current Code language and replace with the following, "Any fire considered by the fire code official to be a nuisance or hazard shall be extinguished immediately. Open burning operations and recreational fires that will be offensive or objectionable because of smoke or odor emissions and any fires, when atmospheric conditions or local circumstances make such fires hazardous, shall be prohibited. The fire code official is authorized to order the immediate extinguishment, by the permit holder or by the fire department, of any fire creating a nuisance or hazardous situation."
11. 307.4.3 Portable outdoor fireplaces.
Delete current code language and replace with the following, "Approved portable outdoor fireplaces shall be used in accordance with the manufacturer's instructions and shall be tested and certified for product safety by Underwriters Laboratories (UL) or Factory Mutual (FM).
Approved portable outdoor fireplaces shall be completely enclosed (solid material or heavy-duty screening or both) with or without a stack or chimney, but those burning combustible materials shall have a screen at the top to prevent large embers that may cause a fire from escaping into the atmosphere.
Approved portable outdoor fireplaces shall not be operated within 15' feet of any combustible material, including, but not limited to, buildings and structures, fences, and decks, or ten (10) feet of all property lot lines. Also Reference VOL 7-4-1 Open Burning"
SECTION 308 OPEN FLAMES
12. 308.1.4 Open-flame cooking devices.
Replace current Code language with the following, "Charcoal burners (barbeques) or any other open-flame cooking devices, including, but not limited to, LPG gas grills, smokers, deep fryers, shall not be operated within ten (10) feet of combustible construction. No cooking devices shall be operated or located on combustible balconies.
Delete paragraphs 2 and 3 of the exceptions.
SECTION 311 VACANT PREMISES
13. 311.2.2 Fire protection.
Delete exceptions.
SECTION 505 PREMISES IDENTIFICATION
14. 505.1 Address identification.
Delete current Code language and replace with the following, "New and existing buildings shall have approved address numbers, building numbers or approved building identification placed in a location that shall be plainly visible from the street or road fronting the property. Address numbers, building numbers or approved building identification shall be affixed to the rear of all tenant space exterior doors in multi-tenant occupancies. Where required by the fire code official, address numbers shall be provided in additional approved locations to facilitate emergency response.
Address numbers shall be Arabic numbers or alphabetical letters and address numbers shall be a minimum of six (6) inches high with a minimum with a minimum stroke width of one-half (1/2) inch wide. Residential address numbers are allowed to be reduced to 4 inches in height. The location of the address numbers shall be approved by the Fire Code Official.
These numbers shall contrast with their background. Address numbers on glass doors, windows, or store fronts shall be white in color.
Where access is by means of a private road and the building cannot be viewed from the public way, a monument, pole or other sign or means shall be used to identify the structure. Address numbers shall be maintained."
SECTION 506 KEY BOXES
15. 506.1 Where required.
Delete last sentence of the current Code language and add the following language, "An approved key box shall be installed on all commercial buildings and all Group R-2 occupancies containing (3) or more dwelling units. The key box shall be obtained from the fire department's designated agent, and shall contain keys to gain necessary access as required by the fire code official.
The key box shall be installed in an approved location in close proximity to the main entrance or where readily accessible and immediately available for use by fire department personnel. The bottom of the key box shall be mounted no less than sixty (60) inches from ground level and the top of the key box shall be mounted no more than seventy-two (72) inches from ground level."
SECTION 507 FIRE PROTECTION WATER SUPPLIES
16. 507.1 Required water supply.
Delete the following language, "premises upon which facilities, buildings or portions of buildings are hereafter constructed or moved into or within the jurisdiction." And replace with the following language, "newly constructed buildings and structures and to existing buildings and structures having the area or height enlarged.
All buildings or structures shall be served by a public water supply system meeting the following criteria. The system shall be under pressure with an average static pressure of not less than 35 pounds per square inch (psi). Flow tests shall be conducted in accordance with NFPA 291 listed in Chapter 44. Flow tests shall be calculated at 20 psi residual pressure. The supplies shall be available for a four (4) hour duration.
No part of any building or structure shall be over 300 feet from at least one public fire hydrant."
17. 507.5.1 Where required.
Delete language and exceptions and replace with the following: Fire hydrants shall be located along a fire apparatus access road so that no portion of the building or structure will be over 300 feet from a single fire hydrant. Additional hydrants and mains shall be provided where required by the fire code official.
18. Add: 507.5.7 Fire Hydrant Installation.
Fire hydrants shall be installed so that:
a. Fire hydrant shall be located along a public street or approved fire apparatus access road.
b. Fire hydrant shall be located at each intersection with intermediate hydrants provided so that distance between hydrants does not exceed three hundred (300) feet.
c. At least one fire hydrant shall be located within 300 feet of the building or structure.
d. Fire hydrant shall be located approximately ten (10) feet from all-weather roadways. If this cannot be done, the closest part of the hydrant shall be set back at least two (2) feet from the curb line.
e. Fire hydrant shall have two 2 1/2 inch outlets and one 4 1/2 inch (steamer) outlet. The 4 1/2 inch (steamer) outlet shall face the primary roadway.
f. Fire hydrant outlets shall be a minimum eighteen (18) inches and no greater than thirty-six (36) inches above the finished grade.
g. Fire hydrant used in conjunction with the water supply shall be of a type approved by the fire code official.
SECTION 806 NATURAL DECORATIVE VEGETATION IN NEW AND EXISTING BUILDINGS
19. 806.1.1 Restricted occupancies.
Delete language and replace with the following: Natural cut trees shall be prohibited in Group A, B, E, F, H, I, M, R-1, R-2, R-4, and S occupancies.
Exception: Delete number one.
SECTION 901 GENERAL
20. Add the following two sections:
901.4.7 Fire Sprinkler Contractors:
The Office of the Illinois State Fire Marshal requires any person, partnership, corporation or other business entity that installs or repairs any fire sprinkler system in Illinois to be licensed. The Fire Sprinkler Contractor Licensing Act [225 ILCS 317/1 et seq.] establishes the minimum standards for licensure of
fire sprinkler installation contractors for the purpose of protecting the public health and general welfare of the citizens of Illinois. A copy of the fire sprinkler contractor's license shall be submitted with the construction documents.
901.4.8 Fire Alarm Contractor:
The Illinois Department of Professional Regulation requires those who design and install fire alarm systems to be licensed. Specifically, 225 ILCS 446 entitled the Private Detective, Private Alarm, Private Security, and Locksmith Act of 1983 defines a "private alarm contractor" as any person who engages in a business that sells, installs, monitors, maintains, alters, repairs, replaces, services, or responds to alarm systems, including fire alarm systems. A copy of the fire alarm contractor's license shall be submitted with the construction documents.
21. 901.5 Installation acceptance testing.
Delete: "before any required acceptance testing." And replace with: not less than forty-eight (48) hours prior to scheduling any required acceptance testing. Electronic as built drawings for all Fire Protection shall be sent to oaklawnfp@oaklawn-il.gov .
22. 901.6.3 Records.
Add the following language: "Records shall be submitted electronically to the Fire Code Official at oaklawnfp@oaklawn-il.gov within 30 days of completion. Failure shall result in fee(s) and or fine(S)."
23. Add: 901.7.7 Fire Watch Required:
The fire code official may require a fire watch upon any premises on which dangerous or hazardous conditions exist. Conditions that may require a fire watch shall include, but are not limited to, the following circumstances:
1. Newly constructed building opened for occupancy prior to completion of the fire safety equipment and supervision.
2. Building in which the fire safety equipment and supervision is placed out of service and will not be restored within one (1) hour.
3. Any time the occupant load is greater than the posted number established for the occupancy.
4. Programs or events where there will be standing room in addition to the seating area and the aisles and exits will accommodate the cumulative occupant load of standing and seated people.
5. Any time additional crowd management is deemed necessary by the fire code official.
24. 901.8 Removal of or tampering with equipment.
Add the following language:
No person shall reset or silence an activated fire signal prior to fire department personnel investigating the cause of the alarm, unless directed to do by the fire code official or a duly authorized representative. If a Fire Alarm is reset prior to the arrival of Fire Department personnel one (1) warning will be given (not per calendar year) then for the second offense the fine will be $600 and $1200 for the third and any additional occurrences. If the issue continues past the third time the fee schedule shall apply and citation(s) for Tampering with a Fire Protection Device that was NOT approved by the Fire Code Official can be issued.
Exception: A known or obvious non-emergency activation may be silenced but not reset.
SECTION 903 AUTOMATIC SPRINKLER SYSTEMS
25. 903.2 Where required.
Add the following language:
Approved automatic sprinkler systems in new buildings and structures shall be provided in all locations where the fire area 3,500 sq. ft. or where the building is > 3 stories above grade.
Exceptions:
1. Approved automatic sprinkler systems shall not be required in open parking structures with roof level < 40 ft. above fire department vehicle access.
26. 903.2.1.1 Group A-1.
Change 12,000 in paragraph 1 to 3,500 and change 300 in paragraph 2 to 200.
27. 903.2.1.2 Group A-2.
Change 5,000 in paragraph 1 to 3,500.
28. 903.2.1.3 Group A-3.

Delete the following language: "where either of the following conditions exist at any time:
1. Four or more care recipients are incapable of self-preservation, whether rendered incapable by staff or staff has accepted responsibility for care recipients already incapable.
2. One or more care recipients that are incapable of self-preservation are
located at other than the level of exit discharge serving such a facility."
32. 903.2.3 Group E.
Delete all language after "Group E occupancies" in the first sentence.
Delete exceptions.
33. 903.2.4 Group F-1.
Change 12,000 in paragraph 1 to 3,500.
Delete paragraphs 2 and 3.
Delete the following language from paragraph 4: "exceeds 2,500 square feet (232 m2)."
34. 903.2.6 Group I.

An automatic sprinkler system shall be provided throughout buildings classified as open automobile parking structures where the roof parking level ? 40 ft. above fire department vehicle access (3 or more tiers and roof parking).
42. Delete Section: 903.2.11.3 Buildings 55 feet or more in height, including exceptions.
43. 903.3.7 Fire department connections.
Add the following language: "within one hundred (100) feet of a fire hydrant and shall be" before the language "approved by the fire code official."
44. 903.4 Sprinkler system supervision and alarms.
Delete paragraph 2 of the exceptions.
45. 903.4.1 Monitoring.
Delete current language and replace with the following: "Alarm, supervisory and trouble signals shall be distinctly different and shall be automatically transmitted by an approved wireless transceiver directly to Oak Lawn Regional Emergency Communications."
SECTION 904 ALTERNATIVE AUTOMATIC FIRE-EXTINGUISHING SYSTEMS
46. 904.3 Installation.
Add the following language: "All new alternative automatic fire-extinguishing systems and all new kitchen hood automatic fire-extinguishing suppression systems shall be monitored by the building fire alarm system."
47. 904.3.5 Monitoring.
Delete the following language "Where a building fire alarm system is installed, automatic" and replace with the following word: Automatic
48. 904.4.2 Alarm testing.
Delete "approved supervising stations" and replace with "Oak Lawn Emergency Regional Communications"
49. 904.11.5 Portable fire extinguishers for commercial cooking equipment.
Add the following language: "All other extinguishers not specifically classified for the protection of Class K fires shall be removed from the room or area housing the commercial-type cooking equipment."
SECTION 905 STANDPIPE SYSTEMS
50. 905.1 General.
Add the following language: "Each standpipe shall be equipped with approved hose connection/outlet valve which discharges horizontally at a height of forty-two (42) inches from the finished floor to the centerline of the valve. The outlet valve shall be placed to provide a minimum clearance of six (6) inches on all sides of the handle and twelve (12) inches on all sides of the threaded outlet."
SECTION 906 PORTABLE FIRE EXTINGUISHERS
51. 906.1 Where required.
Add the following, "Use Group U - Utility/Miscellaneous shall have approved portable extinguishers installed in compliance with NFPA 10 at the direction of the AHJ."
Delete exceptions.
52. 906.2 General requirements.
Add the following language before the language of the adopted Code: "The minimum rated portable fire extinguisher installed shall be a 3-A, 40-B, C -rated extinguisher, and the maximum travel distance to an extinguisher shall be fifty (50) feet.
A minimum of one (1) portable fire extinguisher shall be installed per floor in a multistory building.
Exception: If there is no common hallway running the length of the building in a multistory building, a minimum of one (1) portable fire extinguisher shall be installed in each stairwell.
53. Delete Section 906.3.
54. 906.5 Conspicuous location.
Add the following language: "All locations shall be approved by the fire code official."
55. 906.6 Unobstructed and unobscured.
Add the following language: "All locations shall be approved by the fire code official."
56. 906.8 Cabinets.
Add the following language: "All new construction shall have portable fire extinguishers housed in approved recessed or semi recessed cabinets unless otherwise approved by the Fire Code Official. Cabinets shall be conspicuously marked so as to be easily identified from all directions. The location of the cabinet shall be in compliance with NFPA 10 and shall be approved by the fire department. The approved cabinet shall be manufactured with materials that will not cause harm or injury to the individual accessing the extinguisher. Any cabinet installed within a fire rated wall shall provide the appropriate level of protection to ensure the integrity of the firewall without affecting its fire rating."
SECTION 907 FIRE ALARM AND DETECTION SYSTEMS
57. 907.1 General.
Add the following language:
“It shall be the responsibility of the alarm user to install, test, inspect and maintain an approved fire alarm system in an operative condition at all times, in compliance with all Village adopted codes including the International Building Code, 2018 Edition, the International Fire Code, 2018 Edition and NFPA 72 - National Fire Alarm Code, 2019 Edition.
An approved fire alarm system shall consist of smoke detectors, heat detectors, manual alarm-initiating devices, sprinkler water flow detectors and tamper switches (if applicable), audible and visible notification appliances and annunciation at fire department point of entry. The approved fire alarm system shall provide complete coverage of the building and shall comply with all applicable codes.
In addition:
1. Addressable fire alarm systems shall be installed, unless other application/installation approved by the fire code official.
2. Visible notification appliances shall remain active (flashing) when the automatic and manual fire alarm system is silenced.
3. Exterior waterproof visible notification appliance shall be installed in an approved location on the address-side of the building or other location approved by the fire code official.
4. Activated duct smoke detectors shall initiate a supervisory signal at a constantly attended location.
5. An approved key box shall be installed.
6. A detailed zone/device map shall be posted next to the fire alarm control panel and annunciator panel (if applicable). A copy of said maps shall be submitted to the fire department for approval. An acceptable zone map shall include the following information:
a. Minimum size of 8-1/2" x 11" and shall be clear and legible.
b. Framed and mounted or protected by other acceptable means.
c. Simplified floor plan map showing zone/device locations.
d. Map shall indicate location of alarm panel and annunciator panels and all addressable devices and related controls. If symbols are used, a symbol legend shall be provided.
7. Approved fire alarm systems shall be installed in compliance with the NFPA 70 - National Electrical Code (NEC), 2020 Edition.
Exception: The installation of an approved automatic fire alarm system in all Educational occupancies, Institutional occupancy Groups I-2, I-3 and I-4 and any other occupancy deemed necessary by the AHJ shall be enclosed completely within metallic conduit.
8. All approved fire alarm systems shall transmit trouble, supervisory, and fire signals directly to the Oak Lawn Regional Emergency Communications Center remote supervising station via a wireless radio transceiver installed and maintained in accordance with NFPA 72 - National Fire Alarm Code, 2019 Edition and International Building Code, Chapter 9 - Fire Protection Systems, 2018 edition. All alarm contractors, alarm businesses and alarm supervising stations shall be approved by the fire code official.
The fire alarm contractor supervising the automatic fire alarm system design and installation shall be licensed by the State of Illinois Department of Professional Regulations, per the Illinois Private Detective, Private Alarm, Private Security and Locksmith Act of 1983."
58. 907.1.2 Fire alarm shop drawings.
Add the following language: "Shop drawings for fire alarm systems shall be drawn by an automatic fire alarm contractor licensed by the State of Illinois Department of Professional Regulations or a State of Illinois licensed architect.
3 sets of plans shall be delivered to the Village of Oak Lawn Building Division at 9446 Raymond Avenue, Oak Lawn, IL (lower level). One set of plans will/may then be forwarded to a third party consulting firm for review.
Absolutely no work shall begin on the installation of the fire alarm system prior to receiving an approved plan review from the fire code official and obtaining a fire alarm permit from the Village of Oak Lawn Building Division."
59. 907.2 Where required-new buildings and structures.
Add the following language: "All new buildings and structures shall have an approved fire alarm system installed, except single-family dwellings, two-family dwellings, and related accessory structures."
60. 907.2.1 Group A.
Delete language, including exceptions and replace with the following: "An approved fire alarm system that activates the occupant notification system in accordance with Section 907.5 shall be installed in all Group A occupancies."
61. 907.2.2 Group B.
Delete language, including exceptions and replace with the following: "An approved fire alarm system that activates the occupant notification system in accordance with Section 907.5 shall be installed in all Group B occupancies."
62. 907.2.3 Group E.
Delete "a manual" and replace with "An approved."
63. 907.2.4 Group F.
Delete language, including exceptions and replace with the following: "An approved fire alarm system that activates the occupant notification system in accordance with Section 907.5 shall be installed in all Group F occupancies."
64. 907.2.5 Group H.
Delete "a manual" and replace with "An approved."
65. 907.2.6 Group I.
Delete "a manual" and replace with "An approved."
66. 907.2.7 Group M.
Delete language and replace with the following: "An approved fire alarm system that activates the occupant notification system in accordance with Section 907.5 shall be installed in all Group M occupancies."
Delete paragraph 2 of the exceptions.
67. Delete Section 907.2.7.1.
68. 907.2.8 Group R-1.
Delete language and replace with the following, "An approved fire alarm system that activates the occupant notification system in accordance with Section 907.5 shall be installed in all Group R-1 occupancies."

72. 907.2.9.3 Group R-2 college and university buildings.
Delete the following language, "An automatic smoke detection system that activates the occupant notification system in accordance with Section 907.5 shall be installed in Group R-2 college and university buildings" and replace with the following language: "An approved fire alarm system that activates the occupant notification system in accordance with Section 907.5 shall be installed in all Group R-2 college and university buildings"
Delete the exception.
73. 907.2.10 Single- and multiple-station smoke alarms.

Add: "Occupancies with existing fire alarm systems shall transmit trouble, supervisory, and fire signals directly to the Oak Lawn Regional Emergency Communications Center remote supervising station via a wireless radio transceiver installed and maintained in accordance with NFPA 72 - National Fire Alarm Code, 2019 Edition and International Building Code, Chapter 9 - Fire Protection Systems, 2018 edition. All alarm contractors, alarm businesses and alarm supervising stations shall be approved by the fire code official. The fire alarm contractor supervising the automatic fire alarm system design and installation shall be licensed by the State of Illinois Department of Professional Regulations, per the Illinois Private Detective, Private Alarm, Private Security and Locksmith Act of 1983."
98. 1103.8.1 Where required.
Add the following language, "Single- and multiple-station smoke alarms shall also comply with the Smoke Detector Act, 425 ILCS 60, for required smoke alarm installation and building owner and tenant responsibilities regarding testing, inspection and maintenance of smoke alarms. State laws are enforced through the Illinois Attorney General's Office."
Add the following to the Exceptions, "As the minimum level of acceptable protection, in all existing Group R and I-1 occupancies, an approved smoke alarm shall be installed on the ceiling or wall outside of each separate sleeping area in the immediate vicinity of bedrooms and on each story within a dwelling unit, including basements but not including crawl spaces and uninhabitable attics. In dwellings or dwelling units with split levels and without an intervening door between the adjacent levels, a smoke alarm installed on the upper level shall suffice for the adjacent lower level provided that the lower level is less than one full story below the upper level."
99. Add the following Section, 1103.8.3.1 Dead Batteries
Smoke alarms shall be maintained in an operative condition at all times. If during an inspection, the fire code official or a duly authorized representative finds a solely battery-operated smoke alarm inoperable due to a dead battery, the building owner shall immediately replace the solely battery operated smoke alarm with a listed electrically operated smoke alarm. The smoke alarm shall receive primary power from the building wiring where such wiring is served from a commercial source and shall be equipped with a sealed 10 year battery as a backup.
100. 1103.9 Carbon monoxide alarms.
Add the following language to the exceptions, "Carbon monoxide alarms shall also comply with the, Carbon Monoxide Alarm Detector Act, 430 ILCS 135, for required carbon monoxide alarm installation and building owner and tenant responsibilities regarding testing, inspection and maintenance of smoke alarms. State laws are enforced through the Illinois Attorney General's Office."
101. Add the following Section, 1103.9.1 Power source.
Carbon Monoxide alarms may receive their primary power from the building wiring provide that such wiring is served from a commercial source and shall be equipped with battery backup, may plug into the building's AC power source and shall be equipped with battery backup or may be solely battery operated.
102. Add the following Section, 1103.9.1.2 Dead Batteries
Carbon monoxide alarms shall be maintained in an operative condition at all times. SECTION 5601 GENERAL
103. Add the following Section, 5601.2.4.2.1 Certificate of liability insurance.
The permit holder shall furnish a certificate of liability insurance in the amount of one million dollars ($1,000,000) per occurrence. The policy shall list the Village of Oak Lawn, its officials, employees, agents and volunteers as additionally insured. Also include the event sponsor and its agents and any real property by address within the fallout zone as additionally insured. This shall be furnished at the time of application submittal.
104. Add the following Section, 5601.2.4.2.2 Permit and supervisory fees.
The permit holder shall furnish a bond in the principal sum of one thousand dollars ($1,000) in the form of a cashier's check for the purpose of guaranteeing compliance with all applicable adopted codes and ordinances. The permit holder shall pay a permit fee in the amount of one hundred fifty dollars ($150) and a supervisory fee in the amount of three hundred dollars ($300). Business checks shall be made payable to the Village of Oak Lawn. The bond and fees shall be furnished at the time of application submittal.
SECTION 5608 FIREWORKS DISPLAY
105. 5608.1 General.
Add the following language after paragraph 1, "Shells shall only be fired using electrical ignition or other means of remote ignition that places the shooter and assistants at least seventy-five (75) feet away from the mortar or behind a sturdy barricade at the time of ignition of the lift charge.
Fireworks and pyrotechnic materials shall be loaded into mortars or in place prior to the start of a display, and there shall be no reloading of any fireworks and pyrotechnic materials during firing of the display."
106. 5608.2 Permit application.
Add the following language, "The application for permit for supervised display of fireworks shall be made directly to the fire code official. Each application for a permit shall be made at least thirty (30) days in advance of the date of the display and action on such application shall be taken forty-eight (48) hours after such application is received by the appropriate fire code officials." Permit limitation - After a permit for a supervised display of fireworks has been issued, the possession, sale, use and detonation of fireworks for such display shall be limited for that purpose only. Permit transfer - No permit granted hereunder shall be transferred to any other person, organization or location.
107. 5608.8 Fireworks display supervision.
Add the following language, "Hazardous conditions include, but are not limited to, inadequate spectator separation, unsecured or poorly secured display site perimeter, spectators or vehicles within the display site, the lack of crowd control, high winds, precipitation, drought or other adverse weather conditions."
108. 5608.9 Post-fireworks display inspection.
Add the following language, "Each applicant shall supply the fire code official with an Illinois Office of the State Fire Marshal Pyrotechnic Display Report no later than thirty (30) days after the date of the display."
109. Add the following sections:
5608.10.1 Recovery.
Post-fireworks display inspection and the search for misfired or undetonated fireworks shall begin as soon as it is safe immediately after the display, or not later than sunrise. The area of a misfired or undetonated shell shall be guarded by the display company at their cost from the time of discovery until the recovery and removal of the shell.
5608.10.2 Responsibility.
The supplier of the fireworks shall be solely responsible for the recovery and removal of all fireworks, and aerial displays that have not fired and shall not transfer same to any unlicensed person or organization. Any misfired or defective fireworks shall be noted on the Illinois Office of the State Fire Marshal Pyrotechnic Display Report.
5608.10.3 Cost.
The cost of recovering the shells and removal of the shells shall be solely the responsibility of the fireworks supplier and/or dealer.
C. Definitions:
1. Wherever the word "municipality" is used in the fire prevention code, it shall be held to mean the village of Oak Lawn.
2. Wherever the words "chief of the bureau of fire prevention" are used in the fire prevention code, they shall be held to mean the chief of the fire department.
D. Interpretation: The fire chief or his subordinate within the fire prevention bureau shall so interpret the fire regulations of the fire prevention code, in harmony with the building code and regulations of the village, and shall make no requirements inconsistent with or contrary to the provisions of said building code or regulations.
E. Modification Of Provisions: The chief of the fire department shall have power to modify any of the provisions of the fire prevention code upon application in writing by the owner or lessee, or his duly authorized agent, when there are practical difficulties in the way of carrying out the strict letter of the code; provided, that the spirit of the code shall be observed, public safety secured, and substantial justice done. The particulars of such modification, when granted or allowed, and the decision of the chief of the fire department thereon, shall be entered upon the records of the department and a signed copy shall be furnished the applicant.
F. Enforcement: The fire prevention code shall be enforced by the fire chief of the village. Said chief or his subordinates shall have the authority to call upon the police department for aid in the enforcement of any fire prevention regulation.
G. Smoke Detectors And Carbon Monoxide Detectors: Smoke detectors and carbon monoxide detectors shall be installed and shall be maintained at all times in working order in all buildings in accordance with the requirements of sections 6-2-7-7 and 6-2-7-14 of this code.
