§ 76.08 PARKING RESTRICTIONS DURING SNOW EMERGENCY.
   (A)   Whenever, during any period of 24 hours or less, snow falls in the village to a depth of two inches or more, an emergency is declared to exist in that such a heavy snow storm constitutes a serious public hazard impairing transportation, the movement of fuel and food supplies, medical care, fire, health and police protection, and other vital facilities. Such emergency shall continue until an announcement by the Street Commissioner or the Chief of Police that snow removal operations have been completed.
   (B)   Whenever such an emergency exists, the Street Commissioner or the Chief of Police shall request the Police Department to announce the emergency by its public address system or by radio or television media notification and the time that emergency parking regulations will be effective, which time will be no sooner than on hour after the first announcement, and such announcement shall constitute notice to the general public of the existence of the emergency. However, the owners and operators of motor vehicles shall have full responsibility to determine existing weather conditions and to comply with the emergency regulations.
   (C)   During the period of emergency, the Street Commissioner or the Chief of Police may prohibit parking of any vehicles upon Water Street, Benton Street, Park Street, Church Street, Locust Street, Main Street, East Ottawa Street from Locust Street to Maple Street, Washington Street and any of such other village streets as the Street Commissioner or Police Chief may wish to designate as snow emergency streets. During the emergency, it shall be unlawful for any person to park, cause to be parked, permit to be parked, permit to remain parked, abandon or leave unattended any vehicle of any kind or description upon such streets; provided, however, that vehicles may be parked for a period of not longer than three minutes for actual loading or unloading of passengers or 30 minutes for actual loading or unloading of property; provided further, that no other ordinance restricting parking as to time or place is violated thereby.
   (D)   Any motor vehicle parked in violation of this section may be impounded at the cost and expense of the owner thereof. In addition, any person violating this section shall be fined for the first offense not less than $15 nor more than $25, and for each subsequent offense during the same winter season, not less than $25 nor more than $50, imprisoned for not less than ten days, or both, nor more than 30 days.
