§ 116.016 FRANCHISE REQUIRED; AUTHORITY.
   (A)   Franchise required. No person shall construct, install, maintain or operate, on or within any street, any equipment or facilities for the distribution of television signals, radio signals or other intelligences, either analog or digital, over a BTN to any subscriber, unless a franchise authorizing the use of the streets has first been obtained pursuant to this subchapter, and thereafter only while such person is legally operating under the terms and provisions of the franchise.
   (B)   Scope of authority. Any franchise granted under this subchapter shall give to the grantee, subject to this subchapter, the right and privilege, at its own expense, to construct, erect, operate, modify and maintain in, upon, along, above, over and under the streets, such towers, antennas, cables, electronic equipment and other network appurtenances as are necessary for the operation of the network in the city.
